01 "An Act relating to authorizing the Department of Health and Social Services to                                         
02 enter into an agreement to lease space in a juvenile detention home or                                                  
03 institution."                                                                                                           
04 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF ALASKA:                                                               
05    * Section 1.  AUTHORIZATION TO LEASE CORRECTIONAL FACILITY SPACE                                                   
06 WITH THIRD-PARTY CONTRACTOR OPERATION.  (a)  To replace McLaughlin Youth                                                
07 Center, the Department of Health and Social Services may enter into an agreement for the use                            
08 of space within a juvenile detention home or institution that will house children who are                               
09 committed to the custody of the Department of Health and Social Services.                                               
10  (b)  The agreement for use entered into under this section is predicated upon and must                                 
11 provide for an agreement under which a private third-party contractor builds, owns, and                                 
12 operates the detention home or institution within the Municipality of Anchorage and provides                            
13 care, detention, rehabilitation, and education services for children held by the Department of                          
14 Health and Social Services under authority of state law. The design, construction, repair,                              

01 maintenance, and operation of the detention home or institution must, at a minimum, meet the                            
02 standards and be in accord with the regulations adopted under AS 47.14.010, and the detention                           
03 home or institution must be licensed as provided in AS 47.35.                                                           
04  (c)  The authorization given by (a) of this section is subject to the following condition:                             
05 the lease must provide not less than 200 beds with a physical capability of doubling the                                
06 capacity by multiple bunking or other alternative means.
