01 "An Act relating to authorizing the Department of Corrections to enter into an                                          
02 agreement to lease replacement facilities for the Sixth Avenue Jail for the                                             
03 confinement and care of prisoners with the Municipality of Anchorage; and                                               
04 providing for an effective date."                                                                                       
05 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF ALASKA:                                                               
06    * Section 1.  AUTHORIZATION TO LEASE CORRECTIONAL FACILITY SPACE                                                   
07 WITH THIRD-PARTY CONTRACTOR OPERATION.  (a)  To relieve overcrowding of                                                 
08 existing correctional facilities within the state and the extensive use of out-of-state correctional                    
09 facilities to house Alaska inmates and to replace the Sixth Avenue Jail, the Department of                              
10 Corrections may enter into an agreement with the Municipality of Anchorage to lease space                               
11 within a correctional facility that will house persons who are committed to the custody of the                          
12 commissioner of corrections.  The agreement must provide that the state agrees to lease the                             
13 space for a minimum of 20 years.                                                                                        
14  (b)  The agreement to lease entered into under this section is predicated on and must                                  

01 provide for an agreement between the Municipality of Anchorage and a private third-party                                
02 contractor under which the private third-party contractor designs, builds, and operates the                             
03 facility by providing for custody, care, and discipline services for persons held by the                                
04 commissioner of corrections under authority of state law.                                                               
05  (c)  The authorization given by (a) of this section is subject to the following condition:                             
06 the lease must provide for 200 jail beds with the physical capability to expand by multiple                             
07 bunking to 400 jail beds.                                                                                               
08    * Sec. 2.  APPLICABILITY.  The provisions of AS 33.30.031(a) and (c) do not apply to                               
09 an agreement to lease a correctional facility in accordance with the provisions of sec. 1 of this                       
10 Act.                                                                                                                    
11    * Sec. 3.  This Act takes effect immediately under AS 01.10.070(c).
