00SENATE BILL NO. 304 01 "An Act relating to regulation of highways and motor vehicles; and providing for 02 an effective date." 03 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF ALASKA: 04 * Section 1. AS 28.05.151 is amended by adding a new subsection to read: 05  (d) The supreme court, in establishing scheduled amounts of bail under this 06 section, and each municipality that establishes or has established a fine schedule under 07 this section shall provide that the scheduled amount of bail or fine, as applicable, for 08 a motor vehicle or traffic offense that is committed in a highway work zone shall be 09 double the amount of the bail or fine for the offense if it had not been committed in 10 a highway work zone. 11 * Sec. 2. AS 28.15.231(b) is amended to read: 12  (b) Points may not be assessed for (1) violating a provision of a state law or 13 regulation or a municipal ordinance regulating standing, parking, equipment, size, or 14 weight; (2) [NOR MAY POINTS BE ASSESSED FOR] violations by pedestrians,

01 passengers , or bicycle riders ; (3) [, OR FOR] violations of provisions relating to the 02 preservation of the condition of traffic-control devices on the highways ; (4) violating 03 speed limits on a divided highway where the divided highway has a maximum 04 speed limit of 55 miles per hour, the vehicle was not exceeding 65 miles per hour, 05 and the person operating the vehicle was not driving recklessly or negligently; or 06 (5) traffic citations that are issued by a person who is not a member of the police 07 force of the state or a municipality . Points shall be assessed for violations of 08 oversize or overweight permits relating only to restrictions upon speed or hours of 09 operation. 10 * Sec. 3. AS 28.35 is amended by adding a new section to read: 11  Sec. 28.35.165. Operation of vehicle on state highways or vehicular ways 12 or areas. (a) A person operating a motor vehicle on a divided highway with at least 13 two traffic lanes on each side may not drive in the far left lane, unless the person is 14 overtaking another vehicle, the person is making a left turn from the divided highway, 15 or dense traffic conditions require driving in the left lane. 16  (b) A person who violates this section is guilty of an infraction. 17 * Sec. 4. AS 28.40 is amended by adding a new section to read: 18  Sec. 28.40.070. Fines for offenses committed within highway work zones 19 doubled. Whenever a person violates a provision of this title or a regulation adopted 20 under the authority of this title within a highway work zone, notwithstanding the 21 amount of the fine or the maximum fine set under this title, the fine, or maximum fine, 22 is double the amount provided in this title. 23 * Sec. 5. AS 28.40.100(a) is amended by adding a new paragraph to read: 24  (25) "highway work zone" means an area identified by advance signing 25 where road construction, repair, or maintenance work is being done on or adjacent to 26 a highway, whether or not work is actually being done at that time. 27 * Sec. 6. This Act takes effect June 30, 1999.
