01 "An Act relating to fines and bail forfeiture amounts for certain offenses                                              
02 committed within highway work zones."                                                                                   
03 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF ALASKA:                                                               
04    * Section 1.  AS 28.05.151 is amended by adding a new subsection to read:                                          
05  (d)  The supreme court in establishing scheduled amounts of bail under this                                           
06 section and each municipality that establishes or has established a fine schedule under                                 
07 this section shall provide that the scheduled amount of bail or fine, as applicable, for                                
08 a speeding offense, for the offense of reckless driving under AS 28.35.040, or for the                                  
09 offense of negligent driving under AS 28.35.045 that is committed in a highway work                                     
10 zone shall be double the amount of the bail or fine for the offense if it had not been                                  
11 committed in a highway work zone.                                                                                       
12    * Sec. 2.  AS 28.40 is amended by adding a new section to read:                                                    
13  Sec. 28.40.070.  Fines for speeding offenses committed within highway work                                           
14 zones doubled.  Whenever a person violates a provision of this title relating to                                       

01 speeding, or a regulation adopted under the authority of this title relating to speeding,                               
02 or is convicted of reckless driving under AS 28.35.040 or negligent driving under                                       
03 AS 28.35.045 within a highway work zone, notwithstanding the amount of the fine or                                      
04 the maximum fine set under this title, the fine, or maximum fine, is double the amount                                  
05 provided in this title.                                                                                                 
06    * Sec. 3.  AS 28.40.100(a) is amended by adding a new paragraph to read:                                           
07   (25)  "highway work zone" means an area identified by advance signing                                                
08 where road construction, repair, or maintenance work is being done on or adjacent to                                    
09 a highway, whether or not work is actually being done at that time.
