01 "An Act relating to parole consideration."                                                                              
02 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF ALASKA:                                                               
03    * Section 1.  AS 33.16.130 is amended by adding a new subsection to read:                                          
04  (d)  Before the issuance of the board's decision, the board, at the request of the                                    
05 prisoner, may withdraw consideration of the prisoner's application for discretionary                                    
06 parole.  An application whose consideration has been withdrawn under this subsection                                    
07 may not be further considered by the board.  If the board withdraws consideration of                                    
08 an application under this subsection, the board may not consider an application from                                    
09 that prisoner for the six-month period immediately following the withdrawal unless the                                  
10 board finds that the new application supplies new information not supplied in the                                       
11 withdrawn application and clearly shows that the prisoner is suitable for immediate                                     
12 release on discretionary parole and that consideration of the application within the six-                               
13 month period would not unduly burden or harm a victim of the crime.                                                     
14    * Sec. 2.  22 AAC 20.150(k) is annulled.
