00CS FOR SENATE BILL NO. 214(STA) 01 "An Act relating to the possession of a concealed deadly weapon by peace officers 02 and by chief administrative officers of municipal police departments; relating to 03 the definition of police officer; and providing for an effective date." 04 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF ALASKA: 05 * Section 1. AS 11.61.220(h) is repealed and reenacted to read: 06  (h) The provisions of (a)(1) of this section do not apply to a 07  (1) peace officer of this state or a municipality of this state acting 08 within the scope and authority of the officer's employment; 09  (2) peace officer employed by another state or a political subdivision of 10 another state who, at the time of the possession, is 11  (A) certified as a peace officer by the other state; and 12  (B) acting within the scope and authority of the officer's 13 employment; or 14  (3) police officer of this state or a police officer or chief administrative

01 officer of a municipality of this state; in this paragraph, "police officer" and "chief 02 administrative officer" have the meanings given in AS 18.65.290. 03 * Sec. 2. AS 18.65.290(5) is amended to read: 04  (5) "police officer" means 05  (A) a full-time employee of the state or a municipal [LOCAL] 06 police department with the authority to arrest and issue citations; detain a 07 person taken into custody until that person can be arraigned before a judge or 08 magistrate; conduct investigations of violations of and enforce criminal laws, 09 regulations, and traffic laws; search with or without a warrant persons, 10 dwellings, and other forms of property for evidence of a crime; [CARRY A 11 CONCEALED WEAPON;] and take other action consistent with exercise of 12 these enumerated powers when necessary to maintain the public peace; 13  (B) an officer or employee of the Department of Transportation 14 and Public Facilities who is stationed at an international airport and has been 15 designated to have the general police powers authorized under AS 02.15.230(a); 16  (C) a University of Alaska public safety officer with general 17 police powers authorized under AS 14.40.043; 18 * Sec. 3. This Act takes effect on the date HCS CSSB 141(FIN) am H, enacted by the 19 Twentieth Alaska State Legislature, takes effect.
