00SENATE BILL NO. 180 01 "An Act relating to state rights-of-way." 02 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF ALASKA: 03 * Section 1. AS 19.30 is amended by adding new sections to read: 04 Article 5. Rights-of-way Acquired under Former 43 U.S.C. 932. 05 Sec. 19.30.400. Identification and acceptance of rights-of-way. (a) The 06 state claims, occupies, and possesses each right-of-way granted under former 43 U.S.C. 07 932 that was accepted either by the state or the territory of Alaska or by public users. 08 A right-of-way acquired under former 43 U.S.C. 932 is available for use by the public 09 under regulations adopted by the Department of Natural Resources unless the right-of- 10 way has been transferred by the Department of Natural Resources to the Department of 11 Transportation and Public Facilities in which case the right-of-way is available for use by the 12 public under regulations adopted by the Department of Transportation and Public Facilities. 13 (b) The Department of Natural Resources shall conduct the necessary research 14 to identify rights-of-way that have been accepted by public users under former 43
01 U.S.C. 932 and that have not been previously identified and shall annually report to 02 the legislature by the first day of each regular session of the legislature on rights-of- 03 way that have been identified and that are not listed in this section. 04 (c) The rights-of-way listed in (d) of this section have been accepted by public 05 users and have been identified to provide effective notice to the public of these rights- 06 of-way. Vacation of rights-of-way. Notwithstanding another provision 07 of law, the Department of Natural Resources, the Department of Transportation and 08 Public Facilities, or another agency of the state may not vacate a right-of-way acquired 09 by the state under former 43 U.S.C. 932 unless 10 (1) a reasonably comparable, established alternate right-of-way or 11 means of access exists that is sufficient to satisfy all present and reasonably 12 foreseeable uses; 13 (2) the right-of-way is within a municipality, the municipal assembly 14 has requested the vacation, and the vacation is in the best interests of the state; or 15 (3) the vacation is approved by the legislature. 16 * Sec. 2. Not later than January 1, 1998, the Department of Natural Resources shall record 17 under AS 40.17 each right-of-way identified in AS 19.30.400(d), added by sec. 1 of this Act. 18 In completing the recording, the department and recorder shall not require the rights-of-way 19 to satisfy the requirements of AS 40.17.030.
