00SENATE BILL NO. 169 01 "An Act relating to an exemption from the requirement for payment for overtime 02 under a voluntary work hour plan for work performed by employees at certain 03 mines; and providing for an effective date." 04 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF ALASKA: 05 * Section 1. AS 23.10.060(d) is amended by adding a new paragraph to read: 06 (17) work performed by an employee under a voluntary flexible work 07 hour plan that is not entered into under paragraphs (13) or (14) of this subsection if 08 the employee is employed at a surface metal mining operation that operates year round 09 and if 10 (A) the employee and the employer have signed a written 11 agreement and the written agreement has been filed with the department; and 12 (B) the department has issued a certificate approving the plan 13 that states the work is for 40 hours a week and not more than 12 hours a day; 14 for work over 40 hours a week or 12 hours a day under a flexible work hour
01 plan not entered into under paragraphs (13) or (14) of this subsection, 02 compensation at the rate of one and one-half times the regular rate of pay shall 03 be paid for the overtime. 04 * Sec. 2. This Act takes effect immediately under AS 01.10.070(c).
