ED 1 REAPPROPRIATION. Section 100, ch. 123, SLA 1996, page 76, lines 05 29 - 31, is amended to read: 06 APPROPRIATION OTHER 07 ITEMS FUNDS 08 Ketchikan Gateway Borough 35,000 35,000 09 Improvement to Airport Parking Lot 10 [MURPHYS PULLOUT SEA PLANE DOCK] 11 (ED 1) 12 * Sec. 2. ED 1 REAPPROPRIATIONS. (a) The unexpended and unobligated balance of 13 the appropriation made in sec. 165, ch. 96, SLA 1991, page 66, line 7 (Human Services 14 Center addition/juvenile detention facility - $200,000) is reappropriated to the Department of

01 Administration for payment as a grant under AS 37.05.315 to the City of Ketchikan for 02 juvenile detention facility planning and design. 03 (b) Section 1(a), ch. 123, SLA 1996, is amended to read: 04  (a) The unexpended and unobligated balances of the appropriations made in 05 sec. 21, ch. 79, SLA 1993, page 71, lines 28 - 30 (City of Saxman, community 06 residential center building purchase - $300,000) and in sec. 154, ch. 5, FSSLA 1992, 07 page 84, line 9 (City of Saxman, water and fire service loop - $95,000) are 08 reappropriated to the Department of Administration for payment as a grant under 09 AS 37.05.315 to the City of Saxman for correction of major water and sewer 10 deficiencies [WATER AND SEWER LINE UPGRADES ON EAGLE AND KILLER 11 WHALE AVENUES]. 12 * Sec. 3. ED 2 REAPPROPRIATIONS. ED 13 REAPPROPRIATION. Spurr, Mt. Iliamna, Kennedy major maintenance 20 project - $1,500,000) is reappropriated to the Department of Administration for payment as 21 a grant under AS 37.05.315 to the Municipality of Anchorage for the Anchorage School 22 District for Aurora Elementary School upgrades in playground, parking, soundproof partitions, 23 and intercom and for Mt. Spurr, Mt. Iliamna, and Kennedy maintenance and site 24 improvements. 25 * Sec. 10. ED 15 REAPPROPRIATION. The unexpended and unobligated balance of the 26 appropriation made in sec. 154, ch. 5, FSSLA 1992, page 95, line 9, (Chugach Optional 27 School air balance - $10,000) is reappropriated to the Department of Administration for 28 payment as a grant under AS 37.05.315 to the Municipality of Anchorage, Anchorage School 29 District, for Chugach Optional School maintenance, site improvements, and equipment. 30 * Sec. 11. The unexpended and unobligated balance of the 27 appropriation made in sec. 21, ch. 79, SLA 1993, page 86, lines 21 - 23 (Anchorage School 28 District, Abbott Loop Elementary electric upgrades phase II - $30,000) is reappropriated to 29 the Department of Administration for payment as a grant under AS 37.05.315 to the 30 Municipality of Anchorage for the Anchorage School District for Abbott Loop Elementary 31 maintenance, site improvements, and equipment.

The unexpended and unobligated balance of the 02 appropriation made in sec. 32(a)(2), ch. 41, SLA 1993 (Lake Otis Parkway at Campbell Creek 03 oil separator - $2,000) is reappropriated to the Department of Administration for payment as 04 a grant under AS 37.05.315 to the Municipality of Anchorage for Wickersham Park 05 improvements. 06 * Sec. 16. ED 22 REAPPROPRIATION. The unexpended and unobligated balance of the 07 appropriation made in sec. 21, ch. 79, SLA 1993, page 92, lines 12 - 14 (Anchorage School 08 District, Baxter Elementary lighting upgrades - $50,000) is reappropriated to the Department 09 of Administration for payment as a grant under AS 37.05.315 to the Municipality of 10 Anchorage for the Anchorage School District for Baxter Elementary maintenance, site 11 improvements, and equipment. 12 * Sec. 17. ED 23 REAPPROPRIATIONS. 01 Communities of Memory project. 02 * Sec. 20. ED 34 REAPPROPRIATION. The unexpended and unobligated balance of that 03 portion of the appropriation made in sec. 6(a), ch. 103, SLA 1995, that was distributed by the 04 Department of Education as grant no. 03-96 to the Fairbanks North Star Borough for 05 construction of Crawford Elementary School (elementary school facilities - $8,650,000) is 06 reappropriated to the Department of Administration for payment as a grant under 07 AS 37.05.315 to the Fairbanks North Star Borough for North Pole Elementary School repairs, 08 maintenance, and renovations. 09 * Sec. 21. ED 34 REAPPROPRIATIONS. (a) The unexpended and unobligated balance 10 of the appropriations made in sec. 154, ch. 5, FSSLA 1992, page 106, line 4 (Fairbanks North 11 Star Borough, Salcha Elementary School roof replacement - $49,000) and in sec. 21, ch. 79, 12 SLA 1993, page 108, lines 35 - 38 (Fairbanks North Star Borough, Weller Elementary School 13 buried conductors and exterior lighting - $28,000) are reappropriated to the Department of 14 Administration for payment as a grant under AS 37.05.315 to the Fairbanks North Star 15 Borough for Salcha Elementary School repairs, maintenance, and renovations. 16 (b) The unexpended and unobligated balance of the appropriations made in sec. 135, 17 ch. 103, SLA 1995, page 67, lines 7 - 10 (Fairbanks North Star Borough, North Pole High 18 School auditorium sprinkler system repairs - $79,882) and in sec. 100, ch. 123, SLA 1996, 19 page 74, lines 4 - 7 (Fairbanks North Star Borough, North Pole High School sprinkler systems 20 repairs, supplemental - $81,900) are reappropriated from the individual grant account of the 21 Fairbanks North Star Borough established under AS 37.06.010(b) to the Department of 22 Administration for payment as a capital grant under AS 37.06.010 to the Fairbanks North Star 23 Borough for North Pole High School ice arena construction and improvements. 24 * Sec. 22. ED 35 REAPPROPRIATIONS. (a) The unexpended and unobligated balance 25 of the appropriation made in sec. 21, ch. 79, SLA 1993, page 109, lines 30 - 31 (Whittier 26 roofs for P-12 buildings and firehall - $165,000) is reappropriated to the Department of 27 Administration for payment as a grant under AS 37.05.315 to the City of Whittier for a 28 consolidated municipal facility. 29 (b) The unexpended and unobligated balance of appropriations made (1) from that 30 portion of the appropriation made in sec. 14, ch. 79, SLA 1993, and allocated by sec. 4(b), 31 ch. 80, SLA 1993, to the account in the municipal capital project matching grant fund that the

01 Department of Administration holds in custody for the City of Whittier under AS 37.06.010(b) 02 (Whittier fire hall - $25,000); (2) by sec. 10, ch. 4, FSSLA 1994, page 38, lines 12 - 13 03 (Whittier fire hall renovation - $25,000); (3) by sec. 135, ch. 103, SLA 1995, page 68, lines 04 21 - 22 (Whittier ambulance purchase - $25,000); and (4) by sec. 100, ch. 123, SLA 1996, 05 page 81, lines 33 - 34 (Whittier ambulance purchase - $25,000) are reappropriated to the 06 Department of Administration for payment as a municipal capital matching grant under 07 AS 37.06.010(e) to the City of Whittier for a consolidated municipal facility. 08 (c) The unexpended and unobligated balance of the appropriation made in sec. 165, 09 ch. 96, SLA 1991, page 125, line 21 (Chenega Bay purchase new generator - $50,000) is 10 reappropriated to the Department of Community and Regional Affairs for payment as a grant 11 under AS 37.05.317 to the Chenega Bay IRA Council for completion of the recreational 12 center. 13 * Sec. 23. ED 36 REAPPROPRIATIONS. (a) The unexpended and unobligated balance 14 of the appropriation made in sec. 154, ch. 5, FSSLA 1992, page 116, line 4 (Tok Umbrella 15 Corporation area roads - $200,000) is reappropriated to the Department of Community and 16 Regional Affairs for payment as a grant under AS 37.05.317 to the Tok Umbrella Corporation 17 for area road construction, upgrade, and improvements and civic center parking lot paving and 18 upgrading. 19 (b) The unexpended and unobligated balance of the appropriation made in sec. 10, ch. 20 4, FSSLA 1994, page 38, lines 36 - 37 (Hughes multipurpose building - $25,000) is 21 reappropriated to the Department of Administration for payment as a municipal capital 22 matching grant under AS 37.06.010(e) to the City of Hughes for renovation of the existing 23 multipurpose building. 24 (c) The purpose of that portion of the appropriation made in sec. 14, ch. 79, SLA 25 1993, and allocated under sec. 4(b), ch. 80, SLA 1993, to the account in the municipal capital 26 project matching grant fund that the Department of Administration holds in custody for the 27 City of Chuathbaluk under AS 37.06.010(b), which was awarded as grant number 28 94/531-5-001 by the Department of Administration for public safety relocation is amended to 29 add a public safety vehicle. 30 (d) The unexpended and unobligated balance of the appropriation made in sec. 154, 31 ch. 5, FSSLA 1992, page 111, line 9 (Grayling electrical distribution project - $50,000) is

01 reappropriated to the Department of Administration for payment as a grant under 02 AS 37.05.315 to the City of Grayling for the electrical distribution project and wiring of the 03 teen center and the washeteria building. 04 * Sec. 24. ED 36 REAPPROPRIATION. DEPARTMENT OF NATURAL RESOURCES. (a) Subject to the condition 29 set out in this subsection, the sum of $279,000 is appropriated from the Exxon Valdez oil spill 30 settlement trust recognized in AS 37.14.400 to the Department of Natural Resources for the 31 purchase of the Overlook Park parcel. The appropriation made by this section is conditioned

01 on the Department of Natural Resources and the Kachemak Bay Conservation Society entering 02 into an agreement under which the Society agrees to assume responsibility for monitoring 03 Overlook Park and keeping it clean. 04 (b) It is the intent of the legislature that there will be no state funds required in the 05 future for operating costs for Overlook Park or for capital improvements to the park. 06 * Sec. 43. CAPITAL PROJECT MATCHING GRANT PROGRAMS. (a) The sum of 07 $18,150,000 is appropriated to the municipal capital project matching grant fund 08 (AS 37.06.010(b)) in the Department of Administration to provide grants to municipalities 09 under the municipal capital project matching grant program from the following sources in the 10 amounts listed: 11 SOURCE AMOUNT 12 General fund $13,150,000 13 Alaska Housing Finance Corporation revolving fund 5,000,000 14 (AS 18.56.082) from corporate receipts 15 (b) The sum of $1,850,000 is appropriated from the general fund to the unincorporated 16 community capital project matching grant fund (AS 37.06.020(b)) in the Department of 17 Community and Regional Affairs to provide grants to unincorporated communities under the 18 unincorporated community capital project matching grant program. 19 (c) Amounts equal to the interest earned on money in the individual grant accounts 20 in the municipal capital project matching grant fund (AS 37.06.010(b)) and the 21 unincorporated community capital project matching grant fund (AS 37.06.020(b)) are 22 appropriated from the general fund to the respective funds. The amount of interest is 23 calculated using the average percentage interest rate received by other accounts in the state's 24 general investment fund that received interest during fiscal year 1997. The appropriations 25 made by this subsection are allocated pro rata to each individual grant account based on the 26 balance of the account on the close of business on June 30, 1997. 27 * Sec. 44. FEDERAL AND OTHER PROGRAM RECEIPTS. (a) Federal receipts and 28 receipts of or from the trust established by AS 37.14.400 - 37.14.450 (Exxon Valdez oil spill 29 trust) that exceed the amounts appropriated by this Act are appropriated conditioned on 30 compliance with the program review provisions of AS 37.07.080(h). 31 (b) Contingent on the passage by the First Regular Session of the Twentieth Alaska

01 State Legislature and enactment into law of a bill defining "designated program receipts," 02 designated program receipts as defined by law that exceed the amounts appropriated by this 03 Act are appropriated conditioned on compliance with the program review provisions of 04 AS 37.07.080(h). 05 (c) It is the intent of the legislature that requests for approval of revised programs 06 may be submitted to the Legislative Budget and Audit Committee through the program 07 review process established under AS 37.07.080(h), and that the revised programs be limited 08 to only those items of an emergency nature, such as the loss of funds if action is not taken 09 until the next session of the legislature. Unless the legislature has expressly provided through 10 legislative intent that a revised program be submitted to the Legislative Budget and Audit 11 Committee for a particular agency or program, the Legislative Budget and Audit Committee 12 program review process should not be used to restore funding for budget reductions made by 13 the Twentieth Alaska State Legislature or for program enhancements that must be considered 14 by the full legislature at the next session of the legislature. Requests for capital budget items 15 should be limited to requests for review of emergency items, such as flood damage repair 16 from new federal funds. The Legislative Budget and Audit Committee program review 17 process should not be used to establish new capital projects or to change funding sources for 18 existing capital projects; such requests should be held for consideration by the full legislature 19 during the regular capital appropriation process. 20 (d) If federal or other program receipts as defined in AS 37.05.146 exceed the 21 estimates appropriated by this Act, the appropriations from state funds for the affected 22 program may be reduced by the excess if the reductions are consistent with applicable federal 23 statutes. 24 * Sec. 45. RURAL ELECTRIFICATION REVOLVING LOAN FUND. The balance of 25 the rural electrification revolving loan fund (AS 42.45.020) on June 30, 1997, is appropriated 26 from the loan fund to the Department of Community and Regional Affairs for the electrical 27 emergencies program. 28 * Sec. 46. REPEAL OF PRIOR YEAR CAPITAL APPROPRIATIONS. (a) The 29 unexpended and unobligated balance of an appropriation for a capital project is repealed on 30 (1) June 30, 1998, if the appropriation was effective before July 1, 1991, and 31 the appropriation has not been amended, or, if amended, the most recent amendment to the

01 appropriation was effective before July 1, 1993; 02 (2) June 30, 1999, if the appropriation was effective after June 30, 1993, but 03 before July 1, 1994, and the appropriation has not been amended, or, if amended, the most 04 recent amendment to the appropriation was effective before July 1, 1994; 05 (3) June 30, 2000, if the appropriation was effective after June 30, 1994, but 06 before July 1, 1995, and the appropriation has not been amended, or, if amended, the most 07 recent amendment to the appropriation was effective before July 1, 1995; 08 (4) June 30, 2001, if the appropriation was effective after June 30, 1995, but 09 before July 1, 1996, and the appropriation has not been amended, or, if amended, the most 10 recent amendment to the appropriation was effective before July 1, 1996; 11 (5) June 30, 2002, if the appropriation was effective after June 30, 1996, but 12 before July 1, 1997, and the appropriation has not been amended, or, if amended, the most 13 recent amendment to the appropriation was effective before July 1, 1997. 14 (b) This section does not apply to an appropriation to capitalize a fund. 15 (c) The legislature intends to consider any request to amend an appropriation for a 16 capital project subject to (a) of this section if substantial ongoing work on the project has 17 been started, the project is not expected to be completed by the date of the repeal of the 18 appropriation, the requested amendment to extend the appropriation is included in the 19 governor's annual capital budget, and the governor includes with the requested extension 20 (1) a description of changes to the scope of the project since the initial 21 proposal, if any; 22 (2) the current status of the project; 23 (3) the anticipated project completion date; 24 (4) the unexpended and unobligated balance of the appropriation; and 25 (5) the current estimate of the amount required to complete the project. 26 * Sec. 47. ALASKA SEAFOOD MARKETING INSTITUTE. (a) Contingent on the 28 Alaska Seafood Marketing Institute having no employees who are located outside Alaska 29 whose positions are classified at more than Range 21 on the state salary schedule under 30 AS 39.27.011, and subject to the conditions set out in (b) - (d) of this section, the 31 appropriation made by sec. 31, ch. 117, SLA 1996, page 58, lines 8 - 11, lapses into the

01 general fund June 30, 2000. 02 (b) The Alaska Seafood Marketing Institute may not spend money from this 03 appropriation in the fiscal year ending June 30, 1998. 04 (c) Of the amount appropriated in (a) of this section, the Alaska Seafood Marketing 05 Institute may spend no more than $500,000 in the fiscal year ending June 30, 1999. 06 (d) Of the amount appropriated in (a) of this section, the Alaska Seafood Marketing 07 Institute may spend no more than $500,000 in the fiscal year ending June 30, 2000. 08 * Sec. 49. EXXON VALDEZ OIL SPILL RESTORATION FUND. (a) The legislature 09 finds that 10 (1) as a result of the judgment entered by the United States District Court in 11 the criminal case United States of America v. Exxon Shipping Company and Exxon 12 Corporation, No. A90-015 CR, the state received $50,000,000 in restitution "to be used by the 13 State of Alaska . . . exclusively for restoration projects, within the State of Alaska, relating 14 to the `Exxon Valdez' oil spill"; 15 (2) the money received by the state in restitution is held in the "Exxon Valdez 16 oil spill restoration fund," established by the Department of Revenue, to implement the 17 judgment; and 18 (3) the appropriations in (b) - (f) of this section are made in order to achieve 19 the purposes in the court's restitution order. 20 (b) The sum of $250,000 is appropriated from the income accrued on or before 21 June 30, 1998, on the Exxon Valdez oil spill restoration fund described in (a) of this section 22 to the Department of Fish and Game for the acquisition of equipment for the Mariculture 23 Technical Center and Shellfish Hatchery. 24 (c) The sum of $1,400,000 is appropriated from the income accrued on or before 25 June 30, 1998, on the Exxon Valdez oil spill restoration fund described in (a) of this section 26 to the Department of Transportation and Public Facilities for the construction of a road from 27 Cordova to Shepard Point, the construction of oil spill response equipment storage facilities, 28 and the acquisition of oil spill response equipment for prepositioning at Shepard Point. 29 (d) The sum of $1,750,000 is appropriated from the income accrued on or before 30 June 30, 1998, on the Exxon Valdez oil spill restoration fund described in (a) of this section 31 to the Department of Administration for payment as a grant under AS 37.05.315 to the Kenai

01 Peninsula Borough for the design and construction of the Kenai River Visitors Center in 02 Soldotna, placement of riverbank protection on the site chosen for the center, construction of 03 amenities related to access and use of the Kenai River from the site, and procurement of 04 furnishings and other materials necessary for the center to carry out its purpose. Money may 05 not be expended from the appropriation made in this subsection for any purpose other than 06 the design of the center until 07 (1) the Kenai Peninsula Borough provides, and the commissioner of the 08 Department of Transportation and Public Facilities approves, a construction plan that describes 09 the proposed design and location of the center; and 10 (2) all amounts necessary to finance the work described by the construction 11 plan are obtained by the Kenai Peninsula Borough. 12 (e) The sum of $1,000,000 is appropriated from the income accrued on or before 13 June 30, 1998, on the Exxon Valdez oil spill restoration fund described in (a) of this section 14 to the Department of Fish and Game for research on techniques of fish stock identification or 15 assessment for stocks of salmon injured as a result of the Exxon Valdez oil spill or whose 16 health is of concern, and the assessment of spawning and rearing requirements for stocks of 17 salmon injured as the result of the Exxon Valdez oil spill or whose health is of concern. 18 (f) The unappropriated and unobligated balance of income earned on or before 19 June 30, 1998, on money in the Exxon Valdez oil spill restoration fund described in (a) of this 20 section that remains after deducting the amounts appropriated in (b) - (e) of this section is 21 appropriated to the Department of Community and Regional Affairs for payment as grants 22 under AS 44.47.050 to unincorporated rural communities for purposes of restoring, replacing, 23 or enhancing subsistence resources or services or other services damaged or lost as a result 24 of the Exxon Valdez oil spill. 25 * Sec. 50. ALYESKA SETTLEMENT FUND. (a) Subject to the condition in this 26 subsection, the unappropriated and unobligated balance of the income earned on or before 27 June 30, 1998, on money in the Alyeska settlement fund is appropriated to the Department of 28 Transportation and Public Facilities for the construction of a road from Cordova to Shepard 29 Point, the construction of oil spill response equipment storage facilities, and the acquisition 30 of oil spill response equipment for prepositioning at Shepard Point. To the extent that there 31 are other appropriations made for a project under this appropriation, this appropriation is

01 conditioned on the department's exhausting the other appropriations made for a project under 02 this appropriation before expending money from this appropriation for that project. 03 (b) In this section, the "Alyeska settlement fund" means the trust fund established in 04 the state treasury for the purpose of receiving, holding, and disbursing the settlement proceeds 05 received by the state under the Agreement and Consent Decree In Re: The Exxon Valdez, 06 United States District Court, District of Alaska, Case No. A92-175 Civil, decree entered 07 November 25, 1992. 08 * Sec. 51. The sum of $108,474 is appropriated from the general fund to the Department 17 of Law to pay for judgments and claims against the state for the fiscal year ending 18 June 30, 1997. 19 * Sec. 53. ALASKA COAL WATER FUEL EXPORT AND DIESEL ENGINE PROJECT. 20 (a) The sum of $3,800,000 is appropriated from the income of the Alaska science and 21 technology endowment (AS 37.17.020(a)) to the low-rank coal water fuel project reserve in 22 the Alaska Science and Technology Foundation for payment as a grant under AS 37.17.090(k) 23 for demonstrating the use of Alaska low-rank coal water fuel in diesel engines and developing 24 Alaska low-rank coal water fuel as a product for commercial export. 25 (b) The sum of $22,500,000 is appropriated from university receipts to the University 26 of Alaska for the Alaska low-rank coal water fuel export and diesel engine project. 27 (c) The appropriation made by (a) of this section lapses into the Alaska science and 28 technology endowment income account December 31, 1997, unless the Board of Directors of 29 the Alaska Science and Technology Foundation certifies on or before that date that all of the 30 necessary participants in the Alaska low-rank coal water fuel export and diesel engine project 31 have agreed to participate in the project.

01 * Sec. 54. AMERICAN RED CROSS GRANT LAPSE EXTENSION. That portion of the 02 appropriation made in sec. 30, ch. 117, SLA 1996, page 39, line 8 (Department of Military 03 and Veterans' Affairs for disaster planning and control - $3,161,000) that was awarded by the 04 department as a grant to the American Red Cross lapses into the funds from which 05 appropriated on June 30, 1998. 06 * Sec. 55. An amount equal to the balance of the earnings reserve account (AS 37.13.145) 07 on June 30, 1997, less $100,000,000, less the amount calculated under AS 37.13.145 to offset 08 the effect of inflation on the principal of the permanent fund during fiscal year 1997, and less 09 the amount authorized under AS 37.13.145(b) for transfer to the dividend fund 10 (AS 43.23.045(a)) for the payment of 1997 permanent fund dividends, is appropriated to the 11 principal of the Alaska permanent fund. 12 * Sec. 56. LAPSE PROVISIONS. (a) The appropriations made by secs. 39, 40, and 43 13 of this Act are for capitalization of funds and do not lapse under AS 37.25.010. 14 (b) The appropriations made by secs. 11, 13, 17(a), 18(b), 22(c), 23(a), 29, 32(a)(1) - 15 (3), 32(c), 33(a), 34(a), 34(b), 35(c), 37, 42, 44, 45, 47(b), 49 - 51, 53, and 59 of this Act are 16 for capital projects and lapse under AS 37.25.020. 17 (c) The appropriations made by secs. 19 and 41(c) of this Act lapse June 30, 1998. 18 * Sec. 57. RETROACTIVITY. (a) If they take effect after June 30, 1997, secs. 45 and 19 46 of this Act are retroactive to June 30, 1997. 20 (b) Section 26(c) of this Act is retroactive to July 1, 1994. 21 * Sec. 58. EFFECTIVE DATES. (a) Sections 1 - 26, 27(a), 27(b), 28 - 38, 41(a), 41(b), 22 45 - 48, 52, and 54 - 57 of this Act take effect immediately under AS 01.10.070(c). 23 (b) Sections 39, 40, 41(c), 42 - 44, 49 - 51, 53, 59, and 60 of this Act take effect 24 July 1, 1997. 25 (c) Section 27(c) of this Act takes effect on the day after sec. 59 of this Act takes 26 effect. 27 (SECTION 59 OF THIS ACT BEGINS ON PAGE 30)
