HJR 64: Relating to an amendment to the Constitution of the United States establishing term limits for members of the United States Congress; and, alternatively, calling for a constitutional convention under Article V of the Constitution of the United States.

00HOUSE JOINT RESOLUTION NO. 64 01 Relating to an amendment to the Constitution of the United States establishing 02 term limits for members of the United States Congress; and, alternatively, calling 03 for a constitutional convention under Article V of the Constitution of the United 04 States. 05 BE IT RESOLVED BY THE LEGISLATURE OF THE STATE OF ALASKA: 06 WHEREAS, under Article V of the Constitution of the United States, amendments to 07 the Constitution of the United States may be proposed by the Congress of the United States, 08 or, upon the application of the legislatures of two-thirds of the states, the Congress shall call 09 a constitutional convention for the purpose of proposing amendments; 10 BE IT RESOLVED by the Alaska State Legislature that the Congress of the United 11 States is requested to propose an amendment to the Constitution of the United States for 12 submission to the states for ratification that reads as follows: 13 ARTICLE -- 14  Section A. No person shall serve in the office of the United States

01 Senator for more than two terms, but upon ratification, no person who has held 02 the office of United States Senator or who then holds the office shall serve in 03 the office for more than one additional term. 04  Section B. No person shall serve in the office of United States 05 Representative for more than three terms, but upon ratification no person who 06 has held the office of United States Representative or who then holds the office 07 shall serve for more than two additional terms. 08  Section C. This article shall have no time limit within which it must 09 be ratified to become operative upon the ratification of the legislatures of three- 10 fourths of the States. 11 and be it 12 FURTHER RESOLVED that the Alaska State Legislature makes application and 13 requests that the Congress of the United States call a convention for the sole and exclusive 14 purpose of proposing the same amendment to the Constitution of the United States; and be 15 it 16 FURTHER RESOLVED that the Alaska State Legislature makes the following 17 application: We, the people, and legislature of the State of Alaska, due to our desire to 18 establish term limits on the Congress of the United States, hereby make application to 19 Congress, pursuant to our power under Article V of the United States Constitution, to call 20 an Article V Convention; and be it 21 FURTHER RESOLVED that, if the Congress proposes such an amendment to the 22 Constitution of the United States and submits it to the States for ratification, the application 23 and request for a constitutional convention shall no longer be of any force or effect. 24 COPIES of this resolution shall be sent to the Honorable Bill Clinton, President of 25 the United States; to Gary Sisco, the Secretary of the United States Senate; to Robin Hewlett 26 Carle, the Clerk of the United States House of Representatives; to the Honorable Ted Stevens 27 and the Honorable Frank Murkowski, U.S. Senators, and the Honorable Don Young, U.S. 28 Representative, members of the Alaska delegation in Congress.
