00HOUSE BILL NO. 483 01 "An Act relating to processors of sport caught fish; requiring certain nonresident 02 alien sport fishermen to be accompanied by a sport fishing guide; and providing 03 for an effective date." 04 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF ALASKA: 05 * Section 1. AS 16.05.408 is amended to read: 06  Sec. 16.05.408. Nonresident alien hunter or sport fisherman to be 07 accompanied by guide. (a) It is a class A misdemeanor for a nonresident alien to 08  (1) hunt, pursue, or take a big game animal as defined by the Board of 09 Game unless personally accompanied by a registered guide, master guide, class-A 10 assistant guide, or assistant guide licensed under AS 08.54 ; or 11  (2) take salmon in a sport fishery unless personally accompanied 12 by the owner or employee of a sport fishing guide business that is registered with 13 the department under regulations adopted by the Board of Fisheries; this 14 paragraph does not apply to a nonresident alien who is a citizen of Canada or

01 Mexico . 02  (b) A nonresident alien, when purchasing a big game tag for the taking of an 03 animal specified in (a)(1) [(a)] of this section, shall first furnish to the state, on a form 04 provided by the state, an affidavit showing that the nonresident alien will be 05 accompanied in the hunt by a person who is qualified under the terms of (a)(1) [(a)] 06 of this section. A nonresident alien shall have a copy of the affidavit in possession 07 while in the field hunting. A person who falsifies the required affidavit is guilty of 08 perjury under AS 11.56.200. 09  (c) Before obtaining a nonresident hunt permit for the taking of an animal 10 specified in (a)(1) [(a)] of this section, a nonresident alien shall, if requested by the 11 department, first furnish to the department proof of prior authorization to use federal 12 or private land where the permit hunt will occur. The authorization shall be provided 13 to the nonresident alien by the registered guide or master guide with whom the 14 nonresident alien has contracted to guide the permit hunt. 15 * Sec. 2. AS 16.40 is amended by adding new sections to read: 16 Article 5. Sport Fish Commercial Services. 17  Sec. 16.40.250. Processors of sport caught fish. (a) Each person who 18 engages in the business of processing sport caught fish or who provides processing 19 services to sport fishermen during the course of providing sport fish guide services 20 shall register with the department. 21  (b) A person subject to registration under this section shall maintain records 22 of sport caught fish submitted for processing. The records must include the number 23 and weight of each species of fish, the date the fish were taken, the area where the fish 24 were taken, the type of processing performed on the fish, and the name and sport 25 fishing license number of the person who took the fish. The records must be available 26 for inspection by the Department of Fish and Game and the Department of Public 27 Safety. 28  (c) In this section, "processing" 29  (1) means an activity that 30  (A) modifies the physical condition of a fish, including 31 butchering, freezing, salting, cooking, canning, dehydrating, or smoking; or

01  (B) prepares a fish for shipment, including vacuum packaging; 02 and 03  (2) does not include 04  (A) gutting, gilling, sliming, or washing a fish solely for the 05 purpose of maintaining the quality of a fresh fish; or 06  (B) filleting. 07 * Sec. 3. This Act takes effect January 1, 1999.
