00HOUSE BILL NO. 476 01 "An Act relating to leases of state-owned or state-controlled airport or air 02 navigational facility land." 03 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF ALASKA: 04 * Section 1. AS 02.15.090(c) is amended to read: 05  (c) Notwithstanding the right of the public to rightful, equal, and uniform use 06 under (a) of this section, before the expiration of a land lease, including the 07 termination of a lease in holdover status, entered into under this section, the lessee may 08 apply for a new lease, or for an extended term under the existing lease, for the same 09 land. Only one new lease or extension is allowed under this subsection, and the 10 lessee or the lessee's successors in interest may not apply under this subsection for 11 another new lease or extension for the same land. Notwithstanding (a) of this 12 section, the new lease or extension may be for up to 55 years. The commissioner 13 shall approve the application for a new land lease or an extended term under this 14 section without offering the land to other persons for leasing if

01  (1) the lessee is in compliance with the terms and conditions of the 02 existing or holdover lease; and 03  (2) the continued use of the leasehold is consistent with written airport 04 operation policies and is in the state's best interest. 05 * Sec. 2. AS 02.15.090(c), as amended by sec. 1 of this Act, applies to leases that are in 06 effect on or after the effective date of this Act, except that the limitation on how many times 07 the lessee may apply for a new lease or a lease extension and the limitation on the term of 08 the new lease or extension do not apply to a lease if the lease provides differently.
