00HOUSE BILL NO. 470 01 "An Act relating to the sale of the four dam pool hydroelectric facilities." 02 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF ALASKA: 03 * Section 1. REQUEST FOR PROPOSALS FOR THE SALE OF THE FOUR DAM 04 POOL. (a) The Alaska Energy Authority shall prepare a request for proposals for the sale 05 of the four dam pool. The request for proposals shall be open to any qualified bidder and 06 shall contain terms that will 07 (1) assure that the state receives a fair value for the power projects; 08 (2) protect the electric power rates of the local consumers from unwarranted 09 increase; 10 (3) provide adequate power to the communities to allow for community 11 growth; and 12 (4) allow reserves to the purchasers to ensure that the power projects are 13 adequately maintained and repaired. 14 (b) Notwithstanding AS 44.62.310 and 44.62.312, the governing body or a committee
01 of a municipality may consider and prepare bid documents in response to the request for 02 proposals described in (a) of this section in executive session. The bid document and work 03 papers prepared, acquired, or used in preparation of the bid document are confidential and are 04 not subject to AS 09.25.100 - 09.25.220 until the bids for sale of the four dam pool are 05 opened by the Alaska Energy Authority. 06 (c) In this section, "four dam pool" means the hydroelectric facilities acquired or 07 constructed under the former energy program for Alaska at Tyee Lake, Swan Lake, Solomon 08 Gulch, and Terror Lake.
