00HOUSE BILL NO. 460 01 "An Act relating to funding for public schools; and providing for an effective 02 date." 03 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF ALASKA: 04 * Section 1. AS 14.17.031(b) is amended to read: 05  (b) If the total elementary and secondary instructional units that a school 06 district is eligible to receive under (a) of this section decrease by four [10] percent or 07 more from one fiscal year to the next or decrease by seven percent over two 08 consecutive fiscal years , the school district may use the last fiscal year before the 09 reduction as a base fiscal year and offset its reduction according to the following 10 schedule: (1) for the first fiscal year after the base fiscal year, the school district is 11 eligible to receive the total elementary and secondary instructional units determined 12 under (a)(1) of this section plus 75 percent of the difference in total elementary and 13 secondary instructional units between the base fiscal year and the first fiscal year after 14 the base fiscal year; (2) for the second fiscal year after the base fiscal year, the school

01 district is eligible to receive the total elementary and secondary instructional units 02 determined under (a)(1) of this section plus 50 percent of the difference in total 03 elementary and secondary instructional units between the base fiscal year and the 04 second fiscal year after the base fiscal year; (3) for the third fiscal year after the base 05 fiscal year, the school district is eligible to receive the total elementary and secondary 06 instructional units determined under (a)(1) of this section plus 25 percent of the 07 difference in total elementary and secondary instructional units between the base fiscal 08 year and the third fiscal year after the base fiscal year. The schedule established in 09 this subsection is available to a school district for the three fiscal years following the 10 base fiscal year only if the total elementary and secondary instructional units received 11 by the school district under (a)(1) of this section for each fiscal year are less than the 12 total elementary and secondary instructional units received by the school district in the 13 base fiscal year. This subsection does not apply to a decrease in total elementary and 14 secondary instructional units resulting from a loss of enrollment that occurs as a result 15 of a boundary change under AS 29. 16 * Sec. 2. This Act takes effect July 1, 1998.
