01 "An Act establishing the Eagle Beach State Park."                                                                       
02 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF ALASKA:                                                               
03    * Section 1.  AS 41.21 is amended by adding new sections to article 2 to read:                                     
04  Sec. 41.21.191.  Purpose of AS 41.21.191 - 41.21.194.  (a)  The purpose of                                          
05 AS 41.21.191 - 41.21.194 is to establish the state-owned or acquired land and water                                     
06 described in AS 41.21.192 as the Eagle Beach State Park.  The primary purposes of                                       
07 establishing the Eagle Beach State Park are to                                                                          
08          (1)  protect and preserve the land and water for its unique and                                               
09 exceptional recreational value;                                                                                         
10          (2)  complement and enhance the activities at nearby youth camps;                                             
11   (3)  provide recreational opportunities for camping, hiking, cross-country                                           
12 skiing, picnicking, kayaking, and small off-road vehicle and snow mobile use                                            
13 consistent with state and local land use planning; and                                                                  
14          (4)  provide nature education facilities and programs for children,                                           

01 residents, and visitors to Juneau.                                                                                      
02     (b)  Under AS 38.05.300, state land, water, or land and water containing more                                      
03 than 640 acres may be closed to multiple purpose use only by act of the legislature.                                    
04 Because the area described in AS 41.21.192 exceeds 640 acres, AS 41.21.191 -                                            
05 41.21.194 are intended to provide for the closing of the described land and water to                                    
06 multiple purpose use in conformity with AS 38.05.300 and to dedicate the area as a                                      
07 special purpose site under art. VIII, sec. 7, of the Constitution of the State of Alaska.                               
08     Sec. 41.21.192.  Eagle Beach State Park established.  The presently state-                                       
09 owned land and water and all that acquired in the future by the state lying within the                                  
10 following described parcels are designated as the Eagle Beach State Park:                                               
11          (1)  Township 38 South, Range 64 East, Copper River Meridian                                                  
12                 Section 34:  SE1/4, E1/2SW1/4,                                                                         
13                      excluding ASLS 91-249                                                                              
14                 Section 35:  S1/2N1/2, SE1/4, SW1/4,                                                                   
15                  excluding ASLS 91-249                                                                                  
16           Section 36:  S1/2NW1/4, SW1/4;                                                                              
17          (2)  Township 39 South, Range 64 East, Copper River Meridian                                                  
18                 Section 2:  N1/2, Lot 8, excluding USS1174                                                             
19                 Section 3:  NE1/4, E1/2NW1/4, excluding ASAS 89-117.                                                   
20  Sec. 41.21.193.  Designation of management responsibility.  The state-owned                                         
21 land and water described in AS 41.21.192 is assigned to the department for control,                                     
22 maintenance, and development consistent with the purposes and provisions of                                             
23 AS 41.21.191 - 41.21.194.                                                                                               
24     Sec. 41.21.194.  Incompatible uses.  The commissioner shall designate by                                         
25 regulation incompatible uses within the land and water of the Eagle Beach State Park.
