00HOUSE BILL NO. 437 01 "An Act relating to receipt of permanent fund dividends by certain individuals 02 who have been absent from the state for more than 180 days during a year; and 03 providing for an effective date." 04 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF ALASKA: 05 * Section 1. AS 43.23 is amended by adding a new section to read: 06  Sec. 43.23.017. Dividends of certain individuals who have been absent. (a) 07 An individual who is eligible for a permanent fund dividend and has been absent from 08 the state for more than 180 consecutive days during the year immediately preceding 09 January 1 of the current dividend year, or for more than 180 consecutive days in each 10 of several consecutive years immediately preceding January 1 of the current dividend 11 year, may not receive the dividend until the individual 12  (1) has been physically present in the state for a subsequent year, 13 except that during the subsequent year the individual may have been absent for up to 14 90 days; and

01  (2) is otherwise eligible for the dividend declared for the year 02 immediately following the year that satisfies the requirements of (1) of this subsection. 03  (b) Only one prior year dividend may be paid to an individual during a current 04 dividend year. If, before receiving the prior year dividend, an individual who is 05 eligible to receive a prior year dividend under (a) of this section fails to apply or 06 qualify for a dividend for a subsequent year, that individual becomes ineligible to 07 receive the prior year dividend. 08  (c) If an individual who is eligible to receive a dividend but has not received 09 it dies before satisfying the requirements of (a)(1) and (2) of this section or before 10 receiving the dividend, the department shall pay the dividend to the appropriate person 11 on behalf of the estate of the individual. 12 * Sec. 2. This Act takes effect January 1, 2000.
