00HOUSE BILL NO. 394 01 "An Act relating to seafood processing permits for direct-market fishing operations 02 and to the release of certain information collected by the Department of Fish and 03 Game to the Department of Environmental Conservation." 04 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF ALASKA: 05 * Section 1. AS 03.05.025 is amended by adding a new subsection to read: 06  (c) Notwithstanding AS 44.46.025, the Department of Environmental 07 Conservation shall establish a fee for a seafood processing permit for a direct-market 08 fishing vessel that includes a basic amount of $100 for the permit plus an additional 09 amount that is relative to the quantity of fishery resources that were processed on the 10 vessel during the prior calendar year. The maximum amount of the fee for the permit 11 may not exceed $400. The department may obtain information from the Department 12 of Fish and Game to determine or confirm the quantity of fishery resources that were 13 processed on a vessel during a calendar year. In this subsection, 14  (1) "butchering" means gutting, gilling, heading, cutting, filleting, or

01 otherwise exposing the flesh of a fishery product; 02  (2) "direct-market fishing vessel" means a vessel less than 65 feet in 03 length that catches its own fish and that limits its processing to butchering or freezing 04 fishery products on board the vessel. 05 * Sec. 2. AS 16.05.815(a) is amended to read: 06  (a) Except as provided in (b) and (c) of this section, records required by 07 regulations of the department concerning the landings of fish, shellfish, or fishery 08 products, and annual statistical reports of buyers and processors required by regulation 09 of the department are confidential and may not be released by the department except 10 as set out in this subsection. The department may release the records and reports set 11 out in this subsection to the recipients identified in this subsection if the recipient, 12 other than a recipient under (4) - (6) of this subsection, agrees to maintain the 13 confidentiality of the records and reports. The department may release 14  (1) any of its records and reports to the National Marine Fisheries 15 Service and the professional staff of the North Pacific Fishery Management Council 16 as required for preparation and implementation of the fishery management plans of the 17 North Pacific Fishery Management Council within the exclusive economic zone; 18  (2) any of its records and reports to the Department of Revenue and to 19 the Alaska Commercial Fisheries Entry Commission to assist them in carrying out their 20 statutory responsibilities; 21  (3) records or reports of the total value purchased by each buyer to a 22 municipality that levies and collects a tax on fish, shellfish, or fishery products if the 23 municipality requires records of the landings of fish, shellfish, or fishery products to 24 be submitted to it for purposes of verification of taxes payable; 25  (4) such records and reports as necessary to be in conformity with a 26 court order; 27  (5) on request, the report of a person to the person whose fishing 28 activity is the subject of the report; 29  (6) fish tickets and fish ticket information to the division of fish and 30 wildlife protection, Department of Public Safety; [AND] 31  (7) fish tickets and fish ticket information regarding halibut to the

01 International Pacific Halibut Commission; 02  (8) any of its records and reports to the child support enforcement 03 agency created in AS 25.27.010, or the child support enforcement agency of another 04 state, for child support purposes authorized under law ; and 05  (9) fish tickets, fish ticket information, and other information 06 collected by the department to the Department of Environmental Conservation 07 regarding the quantity of fishery resources harvested and processed by a direct- 08 market fishing vessel for transportation or sale; in this paragraph "direct-market fishing 09 vessel" has the meaning given in AS 03.05.025(c) .
