00HOUSE BILL NO. 297 01 "An Act relating to the definitions of 'general fund,' 'state treasury,' and 02 'program receipts'; and providing for an effective date." 03 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF ALASKA: 04 * Section 1. AS 01.10.060 is amended by adding new paragraphs to read: 05  (15) "general fund" means the fund in the state treasury consisting of 06 all funds and accounts and all money, revenues, receipts, and proceeds of any tax or 07 license, except 08  (A) the permanent fund established by art. IX, sec. 15, 09 Constitution of the State of Alaska; 10  (B) the budget reserve fund established by art. IX, sec. 17, 11 Constitution of the State of Alaska; 12  (C) proceeds of any tax or license dedicated under art. IX, sec. 13 7, Constitution of the State of Alaska; 14  (D) federal funds;

01  (E) trust assets held by the state as trustee of an expressed trust; 02  (F) funds held by public corporations except as otherwise 03 provided by law; 04  (16) "state treasury" means all money, assets, and property and interests 05 in property, whether real or personal, tangible or intangible, owned, held, or otherwise 06 subject to use or disposition by the State of Alaska. 07 * Sec. 2. AS 37.05.146 is repealed and reenacted to read: 08  Sec. 37.05.146. Definition. In AS 37.05.142 - 37.05.146, "program receipts" 09 means fees, charges, income earned on assets, and other state money received by a 10 state agency in connection with the performance of its functions. 11 * Sec. 3. AS 37.07.080 is amended by adding a new subsection to read: 12  (i) In this section, "program receipts" has the meaning given in AS 37.05.146. 13 * Sec. 4. AS 37.10.420(a)(1) is amended to read: 14  (1) "the amount available for appropriation" or "funds available for 15 appropriation" means 16  (A) the unrestricted revenue accruing to the general fund during 17 the fiscal year; 18  (B) general fund program receipts [AS DEFINED IN 19 AS 37.05.146]; 20  (C) the unreserved, undesignated general fund balance carried 21 forward from the preceding fiscal year that is not subject to the repayment 22 obligation imposed by art. IX, sec. 17(d), Constitution of the State of Alaska; 23 and 24  (D) the balance in the statutory budget reserve fund established 25 in AS 37.05.540; 26 * Sec. 5. APPLICATION. (a) Notwithstanding any other statute, the provisions of 27 AS 01.10.060(15) and (16), added by sec. 1 of this Act, supersede any contradictory statute. 28 (b) Nothing in this Act alters the dedication of the proceeds of any tax or license that 29 is dedicated under art. IX, sec. 7, Constitution of the State of Alaska. 30 * Sec. 6. TRANSITION. The governor shall prepare for submission to the president of 31 the senate and the speaker of the house of representatives by the 10th legislative day of the

01 First Regular Session of the Twenty-First Alaska State Legislature a draft bill making 02 technical revisions to the Alaska Statutes to conform with AS 01.10.060(15) and (16), added 03 by sec. 1 of this Act. 04 * Sec. 7. Section 6 of this Act takes effect immediately under AS 01.10.070(c). 05 * Sec. 8. Except as provided in sec. 7 of this Act, this Act takes effect July 1, 1999.
