01 "An Act relating to the provision of electric utility service."                                                         
02 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF ALASKA:                                                                
03    * Section 1.  AS 42.05.221 is amended by adding a new subsection to read:                                            
04  (g)  A certificated electric utility that allows other certificated electric utilities                                
05 to have open access to its own electric system facilities may request the commission                                    
06 to issue orders necessary for the electric utility to immediately be able to use the                                    
07 facilities of another electric utility for the provision of retail electric service in the area                         
08 certificated to the other electric utility if the other electric utility has annual                                     
09 commercial and industrial retail sales of at least 500,000,000 kilowatt hours a year.                                   
10 The commission shall issue the orders requested within 10 days after receiving the                                      
11 request.  The request may include a request for interim refundable tariffs for                                          
12 distribution access services.
