01 "An Act relating to collective bargaining agreements for the overtime wage                                              
02 requirement exemption."                                                                                                 
03 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF ALASKA:                                                                
04    * Section 1.  AS 23.10.060 is amended by adding a new subsection to read:                                            
05  (e)  In this section, a collective bargaining agreement includes, for employees                                       
06 who are not members of a collective bargaining unit, any agreement concerning the                                       
07 hours of work of employees that is approved by a majority vote of the employees                                         
08 whose work will be subject to the agreement.  The department shall supervise the                                        
09 election if at least 25 percent of the employees whose work will be subject to the                                      
10 agreement petition the department to do so.  If the department does not supervise the                                   
11 election, a committee mutually agreed on by employees and the employer shall do so.                                     
12 In the call for an election, the employees shall set the time, date, place, and procedure                               
13 to be used for the election.                                                                                            
14    * Sec. 2.  This Act applies to work performed on or after the effective date of this Act.
