00HOUSE BILL NO. 164 01 "An Act providing that employment as a legislator or with the National Education 02 Association is not credited service under the teachers' retirement system; repealing 03 the limited certificate for teachers of Alaska Native language or culture and 04 removing those teachers from membership in the teachers' retirement system; and 05 repealing a provision permitting members of the teachers' retirement system to 06 count unused sick leave credit as credited service." 07 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF ALASKA: 08 * Section 1. AS 14.20.025 is amended to read: 09  Sec. 14.20.025. Limited teacher certificates. Notwithstanding 10 AS 14.20.020(b), a person may be issued a limited certificate, valid only in the area 11 of expertise for which it is issued, to teach [ALASKA NATIVE LANGUAGE OR 12 CULTURE,] military science [,] or a vocational or technical course for which the 13 board determines by regulation that baccalaureate degree training is not sufficiently 14 available. A limited certificate may be issued under this section only if the school

01 board of the district or regional educational attendance area in which the person will 02 be teaching, through the chief school administrator, has requested its issuance. A 03 person who applies for a limited certificate shall demonstrate, as required by 04 regulations adopted by the board, instructional skills and subject matter expertise 05 sufficient to ensure the public that the person is competent as a teacher. The board 06 may require a person issued a limited certificate to undertake academic training as may 07 be required by the board by regulation and make satisfactory progress in the academic 08 training. 09 * Sec. 2. AS 14.25.220(16) is amended to read: 10  (16) "employer" means a public school district, the Board of Regents of the 11 University of Alaska, the Department of Education, or [THE NATIONAL 12 EDUCATION ASSOCIATION OF ALASKA,] the Regional Resource Centers [, OR 13 THE STATE LEGISLATURE WITH RESPECT TO A STATE LEGISLATOR WHO 14 ELECTS MEMBERSHIP UNDER AS 14.25.040(b)]; 15 * Sec. 3. AS 14.25.040(b), 14.25.040(c), 14.25.045, 14.25.048, 14.25.115(a), 16 14.25.220(6)(B), 14.25.220(21)(D), 14.25.220(21)(F), and 14.25.220(40)(D) are repealed. 17 * Sec. 4. Sections 2 and 3 of this Act apply to persons who first become members of the 18 teachers' retirement system on or after the effective date of this Act.
