00SENATE CS FOR CS FOR HOUSE BILL NO. 137(STA) 01 "An Act relating to veterinarians; extending the termination date of the Board 02 of Veterinary Examiners; and providing for an effective date." 03 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF ALASKA: 04 * Section 1. AS 08.03.010(c)(20) is amended to read: 05 (20) Board of Veterinary Examiners (AS 08.98.010) - June 30, 2001 06 . 07 * Sec. 2. AS 08.98.165(a) is amended to read: 08 (a) An applicant is qualified to receive a license as a veterinarian who 09 (1) is a graduate of an accredited veterinary school or who has 10 successfully completed the Educational [PASSED THE EXAMINATION OF THE 11 NATIONAL BOARD EXAMINATION COMMITTEE'S EDUCATION] Commission 12 for Foreign Veterinary Graduates certification process ; 13 (2) has , within the 60 months preceding application for the license, 14 passed a national [AN] examination for veterinarians approved [PREPARED BY
01 THE NATIONAL BOARD EXAMINATION COMMITTEE OR AN EQUIVALENT 02 EXAMINATION AS DETERMINED] by the board [, OR QUALIFIES FOR AN 03 EXEMPTION UNDER (b) OF THIS SECTION]; 04 (3) has passed the written examination of the state on specific Alaska 05 issues of veterinary practice ; 06 (4) is in good standing, as defined by the board in regulations [HAS 07 PASSED A PRACTICAL EXAMINATION OF SKILLS IF REQUIRED BY THE 08 BOARD]; and 09 (5) has paid required fees [NO DISCIPLINARY PROCEEDING, 10 UNRESOLVED COMPLAINT, OR PROFESSIONAL ASSOCIATION REVIEW 11 PROCEEDING PENDING AT THE TIME A LICENSE IS TO BE ISSUED, AND 12 HAS NOT HAD A VETERINARIAN LICENSE REVOKED FOR CAUSE IN 13 ANOTHER JURISDICTION]. 14 * Sec. 3. AS 08.98.180 is amended to read: 15 Sec. 08.98.180. Temporary license. A person who meets the requirements 16 of AS 08.98.165(a)(1), (4), and (5) [AS 08.98.165(a)(1) AND (5)] is entitled to be 17 temporarily licensed after applying for examination [,] if the person works under the 18 supervision of a licensed veterinarian. A license issued under this section is valid until 19 the results of the examinations are published. A person may not receive more than 20 one temporary license. An application for a temporary license must be signed by the 21 supervising veterinarian and accompanied by the temporary license fee required under 22 AS 08.98.190. 23 * Sec. 4. AS 08.98.184 is amended to read: 24 Sec. 08.98.184. Licensure by credentials. The board shall approve the 25 issuance of a license to an applicant who holds a valid license to practice veterinary 26 medicine in another state, territory, or country [WITH LICENSING REQUIREMENTS 27 SUBSTANTIALLY SIMILAR TO OR HIGHER THAN THOSE OF THIS STATE 28 WHICH WERE IN EFFECT AT THE TIME THE APPLICANT OBTAINED A 29 LICENSE IN THE OTHER JURISDICTION] if the applicant 30 (1) has graduated from an accredited school of veterinary medicine or 31 has successfully completed the Educational [PASSED THE EXAMINATION OF
01 THE NATIONAL BOARD EXAMINATION COMMITTEE'S EDUCATION] 02 Commission for Foreign Veterinary Graduates certification process ; 03 (2) has been engaged in the active practice of veterinary medicine for 04 at least five of the seven years before filing the application; 05 (3) has passed the written examination of the state on specific 06 Alaska issues of veterinary practice [NOT FAILED THE STATE WRITTEN OR 07 PRACTICAL EXAMINATION]; 08 (4) is in good standing, as defined by the board in regulations [HAS 09 NO DISCIPLINARY PROCEEDING, UNRESOLVED COMPLAINTS, OR 10 PROFESSIONAL ASSOCIATION REVIEW PROCEEDINGS PENDING AT THE 11 TIME A LICENSE IS TO BE ISSUED, VETERINARIAN LICENSE REVOKED FOR 12 CAUSE IN ANOTHER JURISDICTION]; and 13 (5) has paid required fees. 14 * Sec. 5. AS 08.98.186 is amended to read: 15 Sec. 08.98.186. Temporary permit. A person licensed to practice veterinary 16 medicine in another state who meets the requirements of AS 08.98.165(a)(1), (4), and 17 (5) [AS 08.98.165(a)(1) AND (5)] may be granted a temporary permit to conduct the 18 practice of a person licensed in the state who is absent from practice. An application 19 shall be signed by the person who is or will be absent from practice and by the 20 applicant. A temporary permit is valid for no longer than 60 days after issuance but 21 may be renewed. 22 * Sec. 6. AS 08.98.165(b) and 08.98.140 are repealed. 23 * Sec. 7. REGULATIONS. Notwithstanding sec. 9 of this Act, the Board of Veterinary 24 Examiners may proceed to adopt regulations necessary to implement the changes made by 25 secs. 2 - 6 of this Act. The regulations take effect under AS 44.62 (Administrative Procedure 26 Act), but not before January 1, 2000. 27 * Sec. 8. Sections 1 and 7 of this Act take effect immediately under AS 01.10.070(c). 28 * Sec. 9. Except as provided in sec. 8 of this Act, this Act takes effect January 1, 2000.
