00HOUSE BILL NO. 118 am 01 "An Act relating to reporting and other requirements of certain employment 02 accidents; and providing for an effective date." 03 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF ALASKA: 04 * Section 1. AS 18.60.058 is amended to read: 05  Sec. 18.60.058. Reporting of injuries and illnesses. (a) In the event of an 06 employment accident that is fatal to one or more employees or that results in the in- 07 patient [OVERNIGHT] hospitalization of one or more employees, the employer shall report 08 the accident orally by telephone [, TELEGRAM, RADIO,] or in person to the nearest office 09 of the division of labor standards and safety or by telephone to the federal toll-free number 10 provided by the division. The report must relate the name of the establishment, the 11 location of the accident, the time of the accident, a contact person and the telephone 12 number of the contact person, a brief description [CIRCUMSTANCES] of the accident, 13 the number of fatalities or hospitalized employees, and the extent of any injuries. The report 14 must be made immediately but in no event later than eight [24] hours after receipt by the

01 employer of information that the accident has occurred. However, if the employer first 02 receives information of a fatality or in-patient hospitalization of one or more employees 03 eight or more hours after the accident but within 30 days after the accident, the 04 employer must make the report within eight hours after receiving information of the 05 fatality or in-patient hospitalization. This subsection does not apply to an employer that 06 first receives information of a fatality or in-patient hospitalization more than 30 days 07 after the accident. 08  (b) In the event of an employment accident that is fatal to one or more 09 employees or that results in in-patient [THE OVERNIGHT] hospitalization of two or 10 more employees, equipment, material, or product related to the injury or fatality may 11 not be moved or altered until clearance is given by the department, except when 12 compliance with this requirement would interfere for an unreasonable length of time 13 with work or create additional hazards. If equipment, material, or products must be 14 moved or altered before department clearance, the employer shall submit a detailed 15 investigative report of the accident to the division. 16 * Sec. 2. This Act takes effect immediately under AS 01.10.070(c).
