00HOUSE BILL NO. 84 01 "An Act limiting the authority to conduct pull-tab charitable gaming to qualified 02 organizations that are exempt from taxation under 26 U.S.C. 501(c)(3) or (19); 03 and providing for an effective date." 04 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF ALASKA: 05 * Section 1. AS 05.15.100(a) is amended to read: 06  (a) The department may issue a permit to a municipality or qualified 07 organization. The permit gives the municipality or qualified organization the privilege 08 of conducting bingo, raffles and lotteries, [PULL-TAB GAMES,] ice classics, rain 09 classics, goose classics, mercury classics, deep freeze classics, mushing sweepstakes, 10 canned salmon classics, salmon classics, king salmon classics, dog mushers' contests, 11 snow machine classics, fish derbies, and contests of skill. Only qualified 12 organizations that have qualified for and received a permit under (e) of this 13 section may conduct pull-tab games. 14 * Sec. 2. AS 05.15.100(d) is amended to read:

01  (d) The department may issue a multiple-beneficiary permit to two to six 02 municipalities or qualified organizations or to a combination of two to six 03 municipalities and qualified organizations that apply jointly for the permit. The permit 04 gives the permit holders the privilege of jointly conducting 05  (1) the activities specified in (a) of this section; and 06  (2) pull-tab games if all of the holders of the permit are qualified 07 organizations that individually have permits to conduct pull-tab games under (e) 08 of this section. 09 * Sec. 3. AS 05.15.100 is amended by adding a new subsection to read: 10  (e) The department may issue a permit to a qualified organization giving the 11 organization the privilege of conducting pull-tab games if the qualified organization 12 is an organization described in 26 U.S.C. 501(c)(3) or (19) (Internal Revenue Code) 13 and is exempt from taxation under 26 U.S.C. 501(a) (Internal Revenue Code). 14 * Sec. 4. AS 05.15.115 is amended by adding a new subsection to read: 15  (e) Only a permittee that has been granted a permit to conduct pull-tab games 16 under AS 05.15.100(e) may contract with an operator to conduct a pull-tab game. 17 * Sec. 5. AS 05.15.185 is amended to read: 18  Sec. 05.15.185. Distribution of pull-tab games. Each series of pull-tabs 19 distributed in the state must be sealed and have a serial number label issued by the 20 National Association of Fundraising Ticket Manufacturers or other serial number label 21 approved by the department and may be distributed only to 22  (1) a [MUNICIPALITY OR A] qualified organization that has obtained 23 a permit issued under AS 05.15.100(e) [THIS CHAPTER]; 24  (2) an operator on behalf of an authorizing permittee permitted to 25 conduct pull-tab games under AS 05.15.100(e); or 26  (3) a distributor licensed under this chapter. 27 * Sec. 6. AS 05.15.187(a) is amended to read: 28  (a) A [MUNICIPALITY OR] qualified organization permitted under 29 AS 05.15.100(e) may operate pull-tab games. Pull-tabs shall be obtained from a 30 licensed distributor. 31 * Sec. 7. AS 05.15.187(f) is amended to read:

01  (f) Each permittee that had gross receipts exceeding $100,000 during the 02 preceding year from activities conducted under this chapter or that is required to report 03 under AS 05.15.080(a), that conducts a pull-tab game shall maintain records for two 04 years of each prize of $50 or more, the first day and last day that each series was 05 distributed, the serial number of each series, and the distributor from whom each series 06 was purchased. In this section, "permittee" includes all [MUNICIPALITIES AND] 07 qualified organizations that jointly hold a multiple-beneficiary permit. 08 * Sec. 8. AS 05.15.188(a) is amended to read: 09  (a) A permittee authorized to conduct pull-tab games under 10 AS 05.15.100(e) may contract with a vendor to sell pull-tabs on behalf of the permittee 11 [,] if the permittee first registers the vendor with the department by applying for 12 registration on a form prescribed by the department and by submitting the registration 13 fee of $50 for each location at which the vendor will sell pull-tabs. 14 * Sec. 9. Section 2, ch. 13, SLA 1995, is repealed and reenacted to read: 15  Sec. 2. AS 05.15.100(a) is repealed and reenacted to read: 16  (a) The department may issue a permit to a municipality or qualified 17 organization. The permit gives the municipality or qualified organization the privilege 18 of conducting bingo, raffles and lotteries, ice classics, rain classics, goose classics, 19 mercury classics, deep freeze classics, canned salmon classics, salmon classics, king 20 salmon classics, dog mushers' contests, snow machine classics, fish derbies, and 21 contests of skill. Only qualified organizations that have qualified for and received a 22 permit under (e) of this section may conduct pull-tab games. 23 * Sec. 10. This Act takes effect January 1, 1998.
