00SENATE CS FOR CS FOR HOUSE BILL NO. 76(FIN) 01 "An Act making appropriations for the operating and capital expenses of the 02 state's integrated comprehensive mental health program; and providing for an 03 effective date." 04 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF ALASKA: 05 * Section 1. PURPOSE. In accordance with AS 37.14.003 and 37.14.005, the 06 appropriations made by this Act are for the state's integrated comprehensive mental health 07 program. 08 * Sec. 2. NONGENERAL FUND RECEIPTS. (a) Mental Health Trust Authority 09 authorized receipts (AS 37.14.036) or administration receipts (AS 37.14.036) that exceed the 10 amounts appropriated by this Act, not to exceed a cumulative total of $1,700,000, are 11 appropriated conditioned upon compliance with the program review provisions of 12 AS 37.07.080(h). It is the intent of the legislature that requests for approval of revised 13 programs may be submitted to the Legislative Budget and Audit Committee through the 14 program review process established under AS 37.07.080(h), and that the revised programs be

01 limited to only those items of an emergency nature, such as the loss of funds if action is not 02 taken until the next session of the legislature. Unless the legislature has expressly provided 03 through legislative intent that a revised program be submitted to the Legislative Budget and 04 Audit Committee for a particular agency or program, the Legislative Budget and Audit 05 Committee program review process should not be used to restore funding for budget 06 reductions made by the Twentieth Alaska State Legislature or for program enhancements that 07 must be considered by the full legislature at the next session of the legislature. Requests for 08 capital budget items should be limited to requests for review of emergency items, such as 09 flood damage repair from new federal funds. The Legislative Budget and Audit Committee 10 program review process should not be used to establish new capital projects or to change 11 funding sources for existing capital projects; such requests should be held for consideration 12 by the full legislature during the regular capital appropriation process. 13 (b) If Mental Health Trust Authority authorized receipts (AS 37.14.036) or 14 administration receipts (AS 37.14.036) fall short of the estimates appropriated in this Act, the 15 affected appropriation is reduced by the amount of shortfall in receipts. 16 (SECTION 3 OF THIS ACT BEGINS ON PAGE 4)
