01 "An Act relating to the exemption from the requirement for payment for overtime                                         
02 under a voluntary work hour plan; and providing for an effective date."                                                 
03 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF ALASKA:                                                                
04    * Section 1.  AS 23.10.060(d)(14) is amended to read:                                                                
05   (14)  work performed by an employee under a voluntary flexible work                                                  
06 hour plan if                                                                                                            
07   (A)  the employee and the employer have signed a written                                                            
08 agreement and the written agreement has been filed with the department; and                                             
09   (B)  the department has issued a certificate approving the plan                                                     
10 that states the work is for 40 hours a week and not more than 12 [10] hours a                                         
11 day; for work over 40 hours a week or 12 [10] hours a day under a flexible                                            
12 work hour plan not included as part of a collective bargaining agreement,                                               
13 compensation at the rate of one and one-half times the regular rate of pay shall                                        
14 be paid for the overtime;                                                                                               

01    * Sec. 2.  This Act takes effect immediately under AS 01.10.070(c).
