01 "An Act relating to partial-birth abortions."                                                                           
02 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF ALASKA:                                                                
03    * Section 1.  AS 18.16 is amended by adding a new section to read:                                                   
04  Sec. 18.16.050.  Partial-birth abortions.  (a)  Notwithstanding compliance                                            
05 with AS 18.16.010, a person may not knowingly perform a partial-birth abortion unless                                   
06 a partial-birth abortion is necessary to save the life of a mother whose life is                                        
07 endangered by a physical disorder, illness, or injury and no other medical procedure                                    
08 would suffice for that purpose.  Violation of this subsection is a class C felony.                                      
09  (b)  A woman upon whom a partial-birth abortion is performed may not be                                               
10 prosecuted under this section or under any other law if the prosecution is based on this                                
11 section.                                                                                                                
12  (c)  In this section, "partial-birth abortion" means an abortion in which the                                         
13 person performing the abortion partially vaginally delivers a living fetus before killing                               
14 the fetus and completing the delivery.
