00SENATE JOINT RESOLUTION NO. 32 01 Proposing amendments to the Constitution of the State of Alaska relating to the 02 constitutional defense council. 03 BE IT RESOLVED BY THE LEGISLATURE OF THE STATE OF ALASKA: 04 * Section 1. Article II, Constitution of the State of Alaska, is amended by adding a new 05 section to read: 06  SECTION 22. CONSTITUTIONAL DEFENSE COUNCIL. There is 07 established in the legislative branch the constitutional defense council. The 08 constitutional defense council may, on behalf of the State, bring actions or intervene 09 in actions involving questions of State or federal constitutional law. Notwithstanding 10 Section 5 of this article, the presiding officers of each house serve as ex officio 11 members of the council, together with the governor and the attorney general. Five 12 appointed members also serve on the council, each subject to confirmation by a 13 majority of the members of the legislature in joint session. One member is appointed 14 by the governor, two are appointed by the presiding officer of the house of

01 representatives, and two are appointed by the presiding officer of the senate. 02 Appointed members serve for five-year terms and may be removed by the appointing 03 authority only for cause. 04 * Sec. 2. Article XV, Constitution of the State of Alaska, is amended by adding a new 05 section to read: 06  SECTION. 29. INITIAL TERMS OF CONSTITUTIONAL DEFENSE 07 COUNCIL MEMBERS. (a) Notwithstanding the term of office for appointed 08 members of the constitutional defense council established in Section 22 of Article II, 09 initial terms are as follows: 10  (1) one member appointed by the speaker of the house of 11 representatives, one year; 12  (2) one member appointed by the governor, two years; 13  (3) one member appointed by the president of the senate, three years; 14  (4) one member appointed by the speaker of the house of 15 representatives, four years; and 16  (5) one member appointed by the president of the senate, five years. 17 * Sec. 3. The amendments proposed by this resolution shall be placed before the voters of 18 the state at the next general election in conformity with art. XIII, sec. 1, Constitution of the 19 State of Alaska, and the election laws of the state.
