00CS FOR SENATE BILL NO. 1005(FIN) am 01 "An Act making and amending appropriations; making appropriations under art. 02 IX, sec. 17(c), Constitution of the State of Alaska, from the constitutional budget 03 reserve fund; providing for an effective date for versions of HB 412 and 04 SB 136 that were passed by the Nineteenth Alaska State Legislature; and 05 providing for an effective date." 06 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF ALASKA: 07 * Section 1. CONSTITUTIONAL BUDGET RESERVE FUND. (a) Amounts equal to 08 the deposits in the budget reserve fund (art. IX, sec. 17, Constitution of the State of Alaska) 09 for fiscal year 1996, that were made by operation of art. IX, sec. 17(d) to repay appropriations 10 from the budget reserve fund are appropriated from the budget reserve fund to the funds and 11 accounts from which they were transferred. 12 (b) If the unrestricted state revenue available for appropriation in fiscal year 1997 is 13 insufficient to cover the general fund appropriations made for fiscal year 1997, the amount 14 necessary to balance revenue and general fund appropriations is appropriated to the general

01 fund from the budget reserve fund (art. IX, sec. 17, Constitution of the State of Alaska). 02 (c) The appropriations made by (a) and (b) of this section are made under art. IX, 03 sec. 17(c), Constitution of the State of Alaska. 04 * Sec. 2. MONETARY TERMS OF COLLECTIVE BARGAINING AGREEMENTS FOR 05 UNIVERSITY EMPLOYEES FOR PRIOR PERIODS. (a) Contingent upon sec. 5 of this 06 Act, the sum of $864,657 is appropriated to the University of Alaska to satisfy the monetary 07 terms of the 1995 collective bargaining agreement between the university and the Alaska 08 Classified Employees Association for the fiscal years ending June 30, 1995, and June 30, 09 1996, from the following funding sources: 10 FUND SOURCE AMOUNT 11 General fund receipts $852,095 12 Federal receipts 4,819 13 University of Alaska dormitory/food/auxiliary service 2,899 14 Student fees 2,225 15 University receipts 2,619 16 (b) Contingent upon sec. 5 of this Act, the sum of $499,108 is appropriated to the 17 University of Alaska to satisfy the monetary terms of the collective bargaining agreement 18 between the university and the Alaska Community College Federation of Teachers for the 19 fiscal year ending June 30, 1996, from the following funding sources: 20 FUND SOURCE AMOUNT 21 General fund receipts $466,207 22 Federal receipts 2,099 23 Student fees 26,302 24 University receipts 4,500 25 * Sec. 3. MONETARY TERMS OF COLLECTIVE BARGAINING AGREEMENTS FOR 26 CERTAIN EXECUTIVE BRANCH EMPLOYEES FOR PRIOR PERIODS. (a) Contingent 27 upon sec. 5 of this Act, the sum of $739,511 is appropriated from the general fund to the 28 Department of Transportation and Public Facilities, Alaska marine highway system, to 29 implement the monetary terms of the collective bargaining agreement with the Inlandboatmen's 30 Union of the Pacific, representing the unlicensed marine unit, for the period October 10, 1994, 31 through May 31, 1996.

01 (b) Contingent upon sec. 5 of this Act, the sum of $80,847 is appropriated from the 02 general fund to the Department of Transportation and Public Facilities, Alaska marine highway 03 system, to implement the monetary terms of the collective bargaining agreement with the 04 International Organization of Masters, Mates, and Pilots, Pacific Maritime Region, representing 05 the Masters, Mates, and Pilots Unit, for the period April 1, 1994, through June 30, 1996. 06 * Sec. 4. MONETARY TERMS AND SALARY ADJUSTMENTS FOR CERTAIN STATE 07 EMPLOYEES FOR FISCAL YEAR 1997. 01 Group health and life benefits fund (AS 39.30.095) 1,900,000 02 (b) Subsection (a) of this section applies to the following collective bargaining 03 agreements: 04 (1) Alaska State Employees Association, for the General Government Unit; 05 (2) Alaska Public Employees Association, for the Supervisory Unit; 06 (3) Public Employees Local 71, for the Labor, Trades, and Crafts Unit; 07 (4) Inlandboatmen's Union of the Pacific, representing the unlicensed marine 08 unit; 09 (5) International Organization of Masters, Mates, and Pilots, Pacific Maritime 10 Region, for the Masters, Mates, and Pilots Unit; 11 (6) Public Safety Employees Association, representing state troopers and other 12 commissioned law enforcement personnel; 13 (7) Alyeska Correspondence School Education Association, representing 14 teachers at the Alyeska Central School; 15 (8) Alaska Vocational Technical Center Teachers' Association, representing 16 teachers at the Alaska Vocational Technical Center; 17 (9) International Brotherhood of Electrical Workers, representing nonjudicial, 18 nonsupervisory, classified employees of the Alaska Court System; 19 (10) Alaska Classified Employees Association, representing certain employees 20 of the University of Alaska; 21 (11) Alaska Community College Federation of Teachers, representing certain 22 employees of the University of Alaska. 23 (c) The amounts appropriated from general fund sources under (a) of this section 24 reflect general fund cost savings of $1,500,000 resulting from new legislation for retirement 25 incentive plans and general fund cost savings of $245,000 resulting from new legislation for 26 the public employees' retirement system for new employees, reduced cost-of-living 27 differential, and other personal services cost reductions, other than retirement incentive plans. 28 The Office of the Governor, office of management and budget, may shift funding among the 29 general fund sources listed in (a) of this section as necessary to fund the appropriation made 30 under (a) of this section, but may not exceed a total of $7,278,800 from general fund match, 31 unrestricted general fund, general fund program receipts, and general fund/mental health fund

01 sources. 02 * Sec. 5. The appropriations made by secs. 2 - 4 of this Act are contingent on the 03 enactment into law of a bill passed by the First Special Session of the Nineteenth Alaska State 04 Legislature that makes a reduction for new employees under the public employees' retirement 05 system, reduces the cost-of-living differential for certain other state employees, approves the 06 monetary terms of collective bargaining agreements between the state and employee collective 07 bargaining units, increases salaries for other state employees, and provides for a retirement 08 incentive program for certain public employees. 09 * Sec. 6. Section 24(c), CCS HB 412(brf fld H/S)(efd fld S) Nineteenth Alaska State 10 Legislature, is amended to read: 11  (c) The sum of $93,141,184 [$94,741,184] is appropriated from the general 12 fund to the Alaska debt retirement fund (AS 37.15.011). 13 * Sec. 7. DISASTER RELIEF FUND. The sum of $4,000,000 is appropriated from the 14 general fund to the disaster relief fund (AS 26.23.300) for costs associated with declared 15 disasters. 16 * Sec. 8. FIRE SUPPRESSION. The sum of $10,000,000 is appropriated to the 17 Department of Natural Resources for fire suppression activities for the fiscal years ending June 18 30, 1996, and June 30, 1997, from the sources and in the amounts listed: 19 SOURCE AMOUNT 20 General fund $5,000,000 21 Federal receipts 5,000,000 22 * Sec. 9. The sum of $200,000 is appropriated from the general fund to the Department 23 of Administration for payment as a grant under AS 37.05.315 to the Matanuska-Susitna 24 Borough for fire response and cleanup expenses due to fires within the borough during 25 calendar year 1996. 26 * Sec. 10. ALASKA PUBLIC UTILITIES COMMISSION. (a) The balance on June 30, 27 1996, of the Alaska Public Utilities Commission designated program receipts account for 28 regulatory cost charges under AS 42.05.254 and AS 42.06.286 for the fiscal year ending 29 June 30, 1996, is appropriated to the Alaska Public Utilities Commission to meet its duties 30 under the Federal Telecommunications Act of 1996 (P.L. 104-104) and shall be assessed 31 against the telephone utilities in the fiscal year ending June 30, 1997.

01 (b) It is the intent of the legislature that the Alaska Public Utilities Commission should 02 carefully review any steps taken by the Federal Communications Commission to implement 03 the 1996 Federal Telecommunications Act before taking any significant action that would 04 affect the current telecommunications marketplace in Alaska. 05 * Sec. 11. (a) The sum of $650,000 that is otherwise subject to lapse into the general fund 06 as of June 30 and August 10, 1994, under former AS 44.83.170(g), is reappropriated from 07 the power project fund (AS 42.45.010) to the Department of Community and Regional Affairs, 08 division of energy, for hydroelectric projects and regional intertie projects. 09 (b) The fund balance in the rural electrification revolving loan fund (AS 42.45.020) 10 on June 30, 1996, otherwise subject to lapse into the general fund (AS 42.45.020(g)), is 11 appropriated to the Department of Community and Regional Affairs, division of energy, for 12 hydroelectric projects and regional intertie projects. 13 * Sec. 12. Section 100, HCS 2d CSSB 136(FIN) am H(brf sup maj fld H)(efd fld S), 14 Nineteenth Alaska State Legislature, page 85, lines 8 - 9, are amended to read: 15 APPROPRIATION OTHER 16 ITEMS FUNDS 17 Point Baker Community Facilities and 25,000 25,000 18 Equipment [WATER SYSTEM 19 PHASE IV] (ED 5) 20 * Sec. 13. The unexpended and unobligated balance, not to exceed $25,000, of the general 21 fund appropriation made by sec. 47, ch. 94, SLA 1995, page 22, line 10 (Medical assistance - 22 $342,667,300) is reappropriated to the Department of Public Safety for payment as a grant 23 under AS 37.05.316 to Victims for Justice for personal services, office supplies, and 24 equipment. 25 * Sec. 14. The unexpended and unobligated balance, not to exceed $200,000, of the general 26 fund appropriation made in sec. 47, ch. 94, SLA 1995, page 22, line 10 (Medical assistance - 27 $342,667,300) is reappropriated to the Department of Health and Social Services for child care 28 benefits to eligible needy families, welfare, and Alaska work programs for the fiscal year 29 ending June 30, 1997. 30 * Sec. 15 The unexpended and unobligated balance, not to exceed $200,000, of the general 31 fund appropriation made in sec. 47, ch. 94, SLA 1995, page 22, line 10 (Medical assistance -

01 $342,667,300) is reappropriated to the Department of Fish and Game for fisheries management 02 activities for the fiscal year ending June 30, 1997. 03 * Sec. 16. The unexpended and unobligated balance, not to exceed $140,000, of the general 04 fund appropriation made in sec. 47, ch. 94, SLA 1995, page 22, line 10 (Medical assistance - 05 $342,667,300) is reappropriated to the Department of Health and Social Services to fund costs 06 of phasing out the Juneau public health laboratory for the fiscal year ending June 30, 1997. 07 * Sec. 17. The sum of $1,615,000 is appropriated from corporate receipts of the Alaska 08 Housing Finance Corporation to the Department of Transportation and Public Facilities for 09 Bethel seawall construction. 10 * Sec. 18. The sum of $250,000 is appropriated from corporate receipts of the Alaska 11 Housing Finance Corporation to the Department of Administration for payment as a grant 12 under AS 37.05.315 to the City of Valdez for reviewing and implementing a study of 13 alternative uses of the Harborview facility. 14 * Sec. 19. EFFECTIVE DATE FOR HB 412. Notwithstanding the failure of the vote on 15 the effective date to the final version of an Act making appropriations for the operating and 16 loan program expenses of state government (HB 412, Nineteenth Legislature, Second Session), 17 the appropriations contained in CCS HB 412(brf fld H/S)(efd fld S) take effect July 1, 1996. 18 * Sec. 20. EFFECTIVE DATE FOR SB 136. Notwithstanding the failure of the vote on 19 the effective dates to sections set out in the final version of an Act making, amending, and 20 repealing appropriations (SB 136, Nineteenth Legislature, Second Session), the appropriations 21 contained in HCS 2d CSSB 136(FIN) am H(brf sup maj fld H)(efd fld S) take effect as 22 follows: 23 (1) secs. 53 - 69, 100, and 101 of HCS 2d CSSB 136(FIN) am H(brf sup maj 24 fld H)(efd fld S) take effect July 1, 1996; and 25 (2) secs. 1 - 52 and 70 - 99 of HCS 2d CSSB 136(FIN) am H(brf sup maj fld 26 H)(efd fld S) take effect immediately under AS 01.10.070(c). 27 * Sec. 21. Sections 2 - 4 of this Act constitute explicit approval of the monetary terms of 28 the collective bargaining agreements described in those sections. 29 * Sec. 22. The appropriation made by sec. 7 of this Act is for the capitalization of a fund 30 and does not lapse. 31 * Sec. 23. The appropriations made by secs. 11 and 17 of this Act are for capital projects

01 and lapse under AS 37.25.020. 02 * Sec. 24. Section 11(a) of this Act is retroactive to June 30, 1994. 03 * Sec. 25. Sections 2, 3, and 5 - 16, and 19 - 24 of this Act take effect immediately under 04 AS 01.10.070(c). 05 * Sec. 26. Except as provided in sec. 25 of this Act, this Act takes effect July 1, 1996.
