01 "An Act relating to civil commitment of a criminal defendant who is found to                                            
02 be mentally incompetent."                                                                                               
03 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF ALASKA:                                                                
04    * Section 1.  AS 47.30.915(12) is amended to read:                                                                   
05   (12)  "mental illness" means an organic, mental, or emotional                                                        
06 impairment that has substantial adverse effects on an individual's ability to exercise                                  
07 conscious control of the individual's actions or ability to perceive reality or to reason                               
08 or understand; in general, mental retardation, epilepsy, drug addiction, and alcoholism                               
09 do not per se constitute mental illness, although persons suffering from these                                          
10 conditions may also be suffering from mental illness; however, for the limited                                         
11 purpose of applying AS 47.30.700 - 47.30.915 to civil commitment of mentally                                            
12 incompetent defendants as authorized under AS 12.47.110(b), "mental illness"                                            
13 includes a mental disease or defect as defined in AS 12.47.130;
