00SENATE BILL NO. 301 01 "An Act relating to postsecondary education." 02 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF ALASKA: 03 * Section 1. AS 14.42.015(a) is amended to read: 04  (a) There is in the Department of Education the Alaska Commission on 05 Postsecondary Education consisting of 06  (1) one member [TWO MEMBERS] of the Board of Regents of the 07 University of Alaska designated by the members of that body; 08  (2) one person representing private higher education in the state 09 selected jointly by the Boards of Trustees of Alaska Pacific University and Sheldon 10 Jackson College from among their membership; 11  (3) one person representing the Department of Education selected by 12 the state Board of Education; 13  (4) four persons broadly and equitably representative of the general 14 public appointed by the governor;

01  (5) [ONE MEMBER OF THE ALASKA HUMAN RESOURCE 02 INVESTMENT COUNCIL ESTABLISHED BY AS 44.19.620 DESIGNATED BY 03 THE MEMBERS OF THAT BODY; 04  (6) ONE PERSON FROM THE MEMBERS OF THE LOCAL 05 COMMUNITY COLLEGE ADVISORY COUNCILS APPOINTED BY THE 06 GOVERNOR; 07  (7)] two members from the legislature, one of whom shall be appointed 08 by the president of the senate and one by the speaker of the house of representatives; 09  (6) [(8)] one person appointed in accordance with (e) of this section 10 who is a full-time student as defined in AS 14.43.160; 11  (7) [(9)] one administrator appointed by the governor from a proprietary 12 institution of postsecondary education that has an authorization to operate in the state 13 issued under AS 14.48. 14 * Sec. 2. AS 14.42.030(a) is amended to read: 15  (a) The commission has the following functions, advisory to the governing 16 boards of institutions of public and private higher education in Alaska, to the governor, 17 the legislature, and to other appropriate state and federal officials: 18  (1) coordinate the development of comprehensive plans for the orderly, 19 systematic growth of public and private postsecondary education, including community 20 colleges and occupational education, in the state and submit recommendations on the 21 need for, and location of, new facilities and programs; 22  (2) advise as to the functions and purposes of the colleges and 23 universities, both public and private, in the state and counsel as to the programs 24 appropriate to each; 25  (3) [REVIEW THE ANNUAL BUDGETS AND CAPITAL OUTLAY 26 REQUESTS OF THE UNIVERSITY OF ALASKA AND OF EACH OF THE 27 PRIVATE COLLEGES AND UNIVERSITIES IN THE STATE, AND PRESENT 28 COMMENTS ON THE GENERAL LEVEL OF SUPPORT SOUGHT; 29  (4)] review and advise as to the working of all consortia and other 30 cooperative agreements between the institutions of higher education in the state that 31 are parties to them [;

01  (5) REPEALED]. 02 * Sec. 3. AS 14.42.030(b) is amended to read: 03  (b) The commission shall 04  (1) [DEVELOP A COMPREHENSIVE STATEWIDE PLAN FOR 05 COORDINATED POSTSECONDARY EDUCATION IN THE STATE AND SERVE 06 AS THE STATE COMMISSION ON POSTSECONDARY EDUCATION REQUIRED 07 UNDER SEC. 1202 OF TITLE XII OF THE HIGHER EDUCATION ACT OF 1965, 08 AS AMENDED BY THE EDUCATION AMENDMENTS OF 1972 (P.L. 92-318, 09 SEC. 196; 86 STAT. 324); 10  (2) ESTABLISH A STATE ADVISORY COUNCIL ON COMMUNITY 11 COLLEGES AND DEVELOP A COMPREHENSIVE STATEWIDE PLAN FOR THE 12 EXPANSION AND IMPROVEMENT OF THE COMMUNITY COLLEGES UNDER 13 SEC. 1001 OF TITLE X OF THE HIGHER EDUCATION ACT OF 1965, 14 AS AMENDED BY THE EDUCATION AMENDMENTS OF 1972 (P.L. 92-318, 15 SEC. 186; 86 STAT. 312, 313); 16  (3) SERVE AS THE STATE AGENCY REQUIRED UNDER SEC. 105 OF 17 TITLE I (COMMUNITY SERVICE AND CONTINUING EDUCATION), 603 OF 18 TITLE VI (FINANCIAL ASSISTANCE FOR UNDERGRADUATE EDUCATION), 19 704 OF TITLE VII (CONSTRUCTION OF ACADEMIC FACILITIES), AND PART 20 B OF TITLE IV (GUARANTEED STUDENT LOAN PROGRAM) OF THE HIGHER 21 EDUCATION ACT OF 1965 (P.L. 89-329; 79 STAT. 1220, 1262; 20 U.S.C. 1005, 22 1123) AS AUTHORIZED BY SEC. 1202(c) OF TITLE XII OF THE HIGHER 23 EDUCATION ACT OF 1965, AS AMENDED BY THE EDUCATION 24 AMENDMENTS OF 1972 (P.L. 92-318, SEC. 196; 86 STAT. 324); 25  (4)] administer the provisions of AS 14.43.090 - 14.43.160 (student 26 loan program); 27  (2) [(5)] administer the provisions of AS 14.48 (regulation of 28 postsecondary educational institutions) [; 29  (6) RESOLVE ANY DISPUTES THAT EXIST OR ARISE UNDER 30 A CONSORTIUM OR OTHER COOPERATIVE AGREEMENT BETWEEN 31 INSTITUTIONS OF PUBLIC AND PRIVATE HIGHER EDUCATION IN THE

01 STATE]. 02 * Sec. 4. AS 14.42.120(a) is amended to read: 03  (a) The corporation shall be governed by a board of directors appointed by the 04 governor consisting of two members of the Alaska Commission on Postsecondary 05 Education, each of whom is selected for the commission under AS 14.42.015(a)(1) - 06 (2), (4), (6), or (7) [(4) - (6), (8), OR (9)] and the commissioner of revenue, the 07 commissioner of administration, and the commissioner of commerce and economic 08 development. Members of the board serve without compensation but the members who 09 are also members of the Alaska Commission on Postsecondary Education are entitled 10 to per diem and travel expenses authorized by law for boards and commissions under 11 AS 39.20.180. 12 * Sec. 5. AS 14.42.055 is repealed.
