01 "An Act relating to release before trial in cases involving controlled substances."                                     
02 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF ALASKA:                                                                
03    * Section 1.  AS 12.30 is amended by adding a new section to read:                                                   
04  Sec. 12.30.023.  RELEASE BEFORE TRIAL IN CASES INVOLVING                                                              
05 CONTROLLED SUBSTANCES.  In determining the conditions of release under                                                  
06 AS 12.30.020 in cases involving a violation of AS 11.71 or AS 11.73, the court shall                                    
07 consider the following conditions and impose one or more conditions it considers                                        
08 reasonably necessary to protect the public safety and security, including ordering the                                  
09 defendant                                                                                                               
10   (1)  not to violate the controlled substance and other laws of the state;                                            
11   (2)  to attend or continue to attend controlled substance counseling or                                              
12 treatment;                                                                                                              
13   (3)  to be subject to a curfew and be in the defendant's residence during                                            
14 certain time periods;                                                                                                   

01   (4)  not to associate with certain persons;                                                                          
02   (5)  not to possess or use cellular telephones, pagers, or other portable                                            
03 communicative devices;                                                                                                  
04   (6)  to engage in drug screening at the defendant's expense with results                                             
05 of the screening supplied to the defendant, the court, and the prosecution; or                                          
06   (7)  not to be present, or within a designated area near, certain locations.
