00SENATE BILL NO. 202 01 "An Act relating to the State Board of Registration for Architects, Engineers, and 02 Land Surveyors." 03 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF ALASKA: 04 * Section 1. AS 08.48.011(b) is amended to read: 05  (b) The board consists of nine members appointed by the governor having the 06 qualifications as set out in AS 08.48.031. The board consists of two civil engineers, 07 one land surveyor, three [ONE MINING ENGINEER, TWO] engineers from other 08 branches of the profession of engineering, two architects, and one public member. In 09 making appointments under this section, other than the appointment of the public 10 member, the governor shall consider persons whose names are submitted to the 11 governor 12  (1) by a recognized professional society for a position on the board 13 that is related to the society's profession; and 14  (2) under a petition signed by at least 20 members of a recognized

01 professional society related to the profession of the position for which the 02 nomination is made. 03 * Sec. 2. AS 08.48 is amended by adding new sections to read: 04  Sec. 08.48.053. PER DIEM; EXPENSES. Notwithstanding AS 08.01.040 and 05 AS 39.20.180, the board may establish a per diem amount to be paid to a board 06 member for each day or portion of a day during which the member is actually engaged 07 in the performance of official duties. The board may also provide that a board 08 member may receive, in addition to per diem, necessary travel or other expenses 09 actually incurred in the performance of official duties. If an advisory council or peer 10 review committee is established by the board, the board may also determine and pay 11 a per diem amount and expenses for the members of the council or committee. 12  Sec. 08.48.055. STAFF. The board may hire or contract for the services of 13 an executive secretary and other staff, including attorneys, investigators, clerical 14 personnel, and consultants, that the board considers necessary to carry out its duties 15 under this chapter. The board shall define by regulation the compensation, 16 qualifications, and duties of persons retained under this section. Persons who are 17 employees of the board under this section are in the exempt service under 18 AS 39.25.110. A person retained under this section may not be a member of the 19 board. 20 * Sec. 3. AS 08.48.061(a) is amended to read: 21  (a) Notwithstanding AS 08.01.050(a), the board shall collect fees imposed 22 under this chapter. All money derived under the provisions of this chapter shall be 23 deposited in the general fund. 24 * Sec. 4. AS 08.48.071(a) is amended to read: 25  (a) Notwithstanding AS 08.01.050(a), the [THE] following record of the 26 board's proceedings and of all applications for registration or authorization shall be 27 kept by the board [DEPARTMENT OF COMMERCE AND ECONOMIC 28 DEVELOPMENT UNDER AS 08.01.050]: 29  (1) the name, age, and last known address of each applicant; 30  (2) the date of application; 31  (3) the place of business of the applicant;

01  (4) the education, experience, and other qualifications; 02  (5) the type of examination required; 03  (6) whether or not the applicant was rejected; 04  (7) whether or not a certificate of registration or authorization was 05 granted or endorsed; 06  (8) the date of the action of the board; 07  (9) other action taken by the board; 08  (10) other information that may be considered necessary by the board. 09 * Sec. 5. AS 08.48.071(e) is amended to read: 10  (e) The board [DEPARTMENT OF COMMERCE AND ECONOMIC 11 DEVELOPMENT] shall [, UNDER AS 08.01.050,] preserve the records under (a) of 12 this section for the previous five years. 13 * Sec. 6. AS 08.48.071(f) is amended to read: 14  (f) The board [DEPARTMENT OF COMMERCE AND ECONOMIC 15 DEVELOPMENT] shall assemble statistics relating to the performance of its staff and 16 the performance of the board, including but not limited to, 17  (1) the number of architects, engineers, and land surveyors registered 18 over a five-year period; 19  (2) the rate of passage of examinations administered by the board; 20  (3) the number of persons making application for registration as a 21 professional architect, engineer, or land surveyor over a five-year period; 22  (4) an account of registration fees collected under AS 08.01.065; 23  (5) a measure of the correspondence workload of any licensing 24 examiner employed by the department or the board to carry out this chapter. 25 * Sec. 7. AS 39.25.110 is amended by adding a new paragraph to read: 26  (31) the principal executive officer and other employees of the State 27 Board of Registration for Architects, Engineers, and Land Surveyors.
