The unexpended and unobligated balance of the appropriation made in sec. 154, 08 ch. 5, FSSLA 1992, page 116, line 12 (Delta Junction, erosion control - $100,000) is 09 reappropriated to the Department of Community and Regional Affairs for payment as a grant 10 under AS 37.05.316 to the Delta Greely Community Coalition to finalize the economic 11 recovery strategy. 12 * Sec. 46. The unexpended and unobligated balance of the appropriation made in sec. 21, 13 ch. 79, SLA 1993, page 102, lines 24 - 25 (Matanuska-Susitna Borough campground upgrades 14 - $50,000) is reappropriated to the Department of Administration for payment as a grant under 15 AS 37.05.315 to the Matanuska-Susitna Borough for parks and recreation upgrades and 16 improvements. 17 * Sec. 47. DEPARTMENT OF ADMINISTRATION. (a) The unexpended and 18 unobligated balance on June 30, 1996, of that portion of the appropriation made in sec. 42, 19 ch. 3, FSSLA 1994, page 14, line 11 (Centralized administrative services - $25,977,800) that 20 is encumbered in encumbrance number 250134 "Arbitration/mediation hearings for FY 1995 21 labor relations backlog of cases" is reappropriated to the Department of Administration, labor 22 relations, for resolution of arbitration cases for the fiscal year ending June 30, 1997. 23 (b) The unexpended and unobligated balance on June 30, 1996, of those portions of 24 the appropriations made in sec. 38, ch. 65, SLA 1993, page 11, line 38 (Office of the 25 Commissioner - $25,950,700) and sec. 5, ch. 2, FSSLA 1994, (Division of Personnel, office 26 of equal employment opportunity - $100,000) that are encumbered in encumbrance number 27 241382, is reappropriated to the Department of Administration, labor relations, for resolution 28 of arbitration cases for the fiscal year ending June 30, 1997. 29 * Sec. 48. DEPARTMENT OF COMMERCE AND ECONOMIC DEVELOPMENT. (a) 30 The unexpended and unobligated balance on June 30, 1996, of the Department of Commerce 31 and Economic Development, division of insurance, general fund program receipts from

01 insurance fees under AS 21.06.250 is appropriated to the Department of Commerce and 02 Economic Development, division of insurance, for operating costs for the fiscal year ending 03 June 30, 1997. 04 (b) That portion of the appropriation to the Department of Commerce and Economic 05 Development, division of economic development, made in sec. 42, ch. 3, FSSLA 1994, page 06 28, line 5, that is encumbered as ARDOR grant for Bering Strait Economic Council is 07 repealed and reappropriated to the Department of Commerce and Economic Development for 08 the Arctic-Yukon-Kuskokwim Salmon Targeted Marketing pilot program. 09 (c) The unexpended and unobligated balance on June 30, 1996, of the appropriation 10 made in sec. 19, ch. 79, SLA 1993, page 15, lines 13 - 14, after the reappropriation made by 11 sec. 59, ch. 8, FSSLA 1994 (Coal initiatives/test shipment project - $150,000) is 12 reappropriated to the Department of Commerce and Economic Development for the Arctic- 13 Yukon-Kuskokwim Salmon Targeted Marketing pilot program. 14 (d) The sum of $29,000 is appropriated from program receipts from the consent 15 agreement between the State of Alaska and Paine Webber, Inc., for sales practice violations 16 of the Alaska Securities Act to the Department of Commerce and Economic Development, 17 division of banking, securities, and corporations, for enhancing investor protection and 18 expanding public awareness for the fiscal years ending June 30, 1996, and June 30, 1997. 19 * Sec. 49. DEPARTMENT OF CORRECTIONS. The sum of $500,000 is appropriated 20 from the correctional industries receipts in the general fund to the Department of Corrections 21 to pay for raw materials and other related costs of the correctional industries program for the 22 fiscal year ending June 30, 1996. 23 * Sec. 50. DEPARTMENT OF EDUCATION. The sum of $57,000 is appropriated from 24 the general fund program receipts to the Department of Education to pay additional costs of 25 the state museum programs for the fiscal year ending June 30, 1996. 26 * Sec. 51. DEPARTMENT OF LAW. The sum of $1,148,126 is appropriated from the 27 general fund to the Department of Law to pay judgments and claims against the state for the 28 fiscal year ending June 30, 1996. 29 * Sec. 52. MISCELLANEOUS CLAIMS. The following amounts are appropriated from 30 the general fund to the following departments to pay miscellaneous claims and stale-dated 31 warrants for the fiscal year ending June 30, 1996:

01 DEPARTMENT APPROPRIATION 02 Administration $1,624 03 Law 206 04 * Sec. 53. RATIFICATION. The departmental expenditure listed below which was made 05 in fiscal year 1994 is ratified. The ratification will reverse the negative account balance in 06 the Alaska State Accounting System in the amount listed for the AR number. The 07 appropriation from which this expenditure was actually paid is amended by increasing it by 08 the amount listed: 09 Public Safety - AR46562-94 HSPA/Operations $1,100 10 * Sec. 54. CAPITAL PROJECT MATCHING GRANT PROGRAMS. (a) The sum of 11 $13,300,000 is appropriated from the general fund to the municipal capital project matching 12 grant fund (AS 37.06.010(b)) in the Department of Administration to provide grants to 13 municipalities under the municipal capital project matching grant program. 14 (b) The sum of $1,700,000 is appropriated from the general fund to the unincorporated 15 community capital project matching grant fund (AS 37.06.020(b)) in the Department of 16 Community and Regional Affairs to provide grants to unincorporated communities under the 17 unincorporated community capital project matching grant program. 18 (c) An amount equal to the interest earned on money in the individual grant accounts 19 in the municipal capital project matching grant fund (AS 37.06.010(b)) and the unincorporated 20 community capital project matching grant fund (AS 37.06.020(b)) is appropriated from the 21 general fund to the respective funds. The interest shall be based on the average percentage 22 interest rate received by other accounts in the state's general investment fund that received 23 interest during fiscal year 1996. The appropriations made by this subsection are allocated pro 24 rata to each individual grant account based on its balance as of the close of business on 25 June 30, 1996. 26 * Sec. 55. FEDERAL OR OTHER PROGRAM RECEIPTS. Federal or other program 27 receipts as defined under AS 37.05.146 that exceed the amount appropriated by sec. 80 of this 28 Act are appropriated conditioned upon compliance with the program review provisions of 29 AS 37.07.080(h). 30 * Sec. 56. It is anticipated that the members of the Alaska Industrial Development and 31 Export Authority will authorize the purchase of loans with a reasonable value of $650,000

01 from the rural development initiative fund (AS 44.47.800) as an investment for the Alaska 02 Industrial Development and Export Authority revolving fund (AS 44.88.060). Conditioned 03 on the approval described above, loans with a reasonable value of $650,000 are appropriated 04 from the rural development initiative fund to the Alaska Industrial Development and Export 05 Authority revolving fund. The proceeds from the sale of loans authorized by this section are 06 appropriated from corporate receipts to the rural development initiative fund for the purposes 07 of the fund. 08 * Sec. 57. The unexpended and unobligated balance in the Alaska Science and Technology 09 Endowment earnings reserve as of June 30, 1996, is appropriated to the Alaska Science and 10 Technology Foundation to award as grants under AS 37.17.030(d) for the fiscal year ending 11 June 30, 1997. 12 * Sec. 58. (a) The unexpended and unobligated balance of the appropriation, not to exceed 22 $40,000, made in sec. 163, ch. 96, SLA 1991, page 39, line 21 (Beaufort and Chukchi Seas 23 coastline mapping - $150,000) is repealed and reappropriated to the Department of Natural 24 Resources for repairs to Fire Lake Dam. 25 (b) The unexpended and unobligated balance, after the reappropriation made in (a) of 26 this section, of the appropriation made in sec. 163, ch. 96, SLA 1991, page 39, line 21 27 (Beaufort and Chukchi Seas coastline mapping - $150,000) is repealed and reappropriated to 28 the Department of Natural Resources for offshore boundary mapping and tide gauging. 29 * Sec. 61. If the unrestricted state revenue available for appropriation in fiscal year 1997 28 is insufficient, after the appropriation to the general fund made in sec. 68 of this Act, to cover 29 the general fund appropriations made for fiscal year 1997, the amount necessary to balance 30 revenue and general fund appropriations is appropriated to the general fund from the budget 31 reserve fund (art. IX, sec. 17, Constitution of the State of Alaska). If the appropriation made

01 by this subsection is approved by the affirmative vote of at least three-fourths of the members 02 of each house of the legislature, the appropriation is made under art. IX, sec. 17(c), 03 Constitution of the State of Alaska. If the appropriation made by this subsection is not 04 approved by at least three-fourths vote of each house of the legislature, then the appropriation 05 is made under art. IX, sec. 17(b), Constitution of the State of Alaska, and the amount 06 appropriated under this subsection is limited to the amount permitted under art. IX, sec. 17(b). 07 * Sec. 68. If the unrestricted state revenue available for appropriation in the fiscal year that 08 ends June 30, 1997, is insufficient to cover the general fund appropriations made for that fiscal 09 year, the amount necessary to balance revenue and general fund appropriations is appropriated 10 to the general fund from the budget reserve fund (AS 37.05.540). 11 * Sec. 69. In its review of agency operations plans prepared under AS 37.07.080, it is the 12 intent of the legislature that the office of management and budget control state expenditures 13 to prevent any cash or budget shortfalls during fiscal year 1997. These controls are intended 14 to limit the use of the budget reserve fund (art. IX, sec. 17, Constitution of the State of 15 Alaska) to the greatest extent possible, and to reduce supplemental budget requests in the First 16 Session of the Twentieth Alaska State Legislature. 17 * Sec. 70. SETTLEMENTS AND CLAIMS. The sum of $2,600,000 is appropriated from

01 the general fund to the Department of Law to pay the settlement in Kerr v. State, DOC, et al. 02 (3AN-93-6531 CI) for the fiscal year ending June 30, 1996. 03 * Sec. 72. CAPITAL LAPSE. The appropriations made by secs. 11(a)(2)(A) - (E), 11(c), 04 20(b), 20(c), 20(e), 20(f), 23, 24(a)(2), 24(c), 28(a), 33(e), 33(f), 35, 40(b), 48(b), 48(c), 55, 05 59, 60, 66, 70, and 80 of this Act are for capital projects and lapse under AS 37.25.020. 06 * Sec. 73. The appropriations made by sec. 54 of this Act are to capitalize funds and do 07 not lapse under AS 37.25.010. 08 * Sec. 74. Section 13(a) of this Act is retroactive to June 30, 1994. 09 * Sec. 75. Section 26(d) of this Act is retroactive to July 7, 1993. 10 * Sec. 76. Section 31(a) of this Act is retroactive to July 1, 1994. 11 * Sec. 77. Section 31(b) of this Act is retroactive to July 1, 1995. 12 * Sec. 78. Sections 54 - 70, 80, and 81 of this Act take effect July 1, 1996. 13 * Sec. 79.
