002d CS FOR SENATE BILL NO. 136(FIN) 01 "An Act making, amending, and repealing appropriations; making appropriations 02 under art. IX, sec. 17(c), Constitution of the State of Alaska, from the 03 constitutional budget reserve fund; and providing for an effective date." 04 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF ALASKA: 05 * Section 1. CAPITAL PROJECT MATCHING GRANT PROGRAMS. (a) The sum of 06 $13,300,000 is appropriated from the general fund to the municipal capital project matching 07 grant fund (AS 37.06.010(b)) in the Department of Administration to provide grants to 08 municipalities under the municipal capital project matching grant program. 09 (b) The sum of $1,700,000 is appropriated from the general fund to the unincorporated 10 community capital project matching grant fund (AS 37.06.020(b)) in the Department of 11 Community and Regional Affairs to provide grants to unincorporated communities under the 12 unincorporated community capital project matching grant program. 13 (c) An amount equal to the interest earned on money in the individual grant accounts 14 in the municipal capital project matching grant fund (AS 37.06.010(b)) and the unincorporated

01 community capital project matching grant fund (AS 37.06.020(b)) is appropriated from the 02 general fund to the respective funds. The interest shall be based on the average percentage 03 interest rate received by other accounts in the state's general investment fund that received 04 interest during fiscal year 1996. The appropriations made by this subsection are allocated pro 05 rata to each individual grant account based on its balance as of the close of business on 06 June 30, 1996. 07 * Sec. 2. FEDERAL OR OTHER PROGRAM RECEIPTS. Federal or other program 08 receipts as defined under AS 37.05.146 that exceed the amount appropriated by sec. 19 of this 09 Act are appropriated conditioned upon compliance with the program review provisions of 10 AS 37.07.080(h). 11 * Sec. 3. It is anticipated that the members of the Alaska Industrial Development and 12 Export Authority will authorize the purchase of loans with a reasonable value of $650,000 13 from the rural development initiative fund (AS 44.47.800) as an investment for the Alaska 14 Industrial Development and Export Authority revolving fund (AS 44.88.060). Conditioned 15 on the approval described above, loans with a reasonable value of $650,000 are appropriated 16 from the rural development initiative fund to the Alaska Industrial Development and Export 17 Authority revolving fund. The proceeds from the sale of loans authorized by this section are 18 appropriated from corporate receipts to the rural development initiative fund for the purposes 19 of the fund. 20 * Sec. 4. The unexpended and unobligated balance in the Alaska Science and Technology 21 Endowment earnings reserve as of June 30, 1996, is appropriated to the Alaska Science and 22 Technology Foundation to award as grants under AS 37.17.030(d) for the fiscal year ending 23 June 30, 1997. 24 * Sec. 5. Section 10, ch. 4, FSSLA 1994, page 11, lines 26 - 28, is amended to read: 25 APPROPRIATION GENERAL 26 ITEMS FUND 27 Arctic-Yukon-Kuskokwim salmon fisheries 300,000 300,000 28 stock assessment projects [EQUIPMENT] (ED 99) 29 * Sec. 6. The unexpended and unobligated balance of the appropriation made in sec. 139, 30 ch. 208, SLA 1990, page 59, line 13 (Beaufort Sea tide gauging - $113,000) is repealed and 31 reappropriated to the Department of Natural Resources for offshore boundary mapping and

01 tide gauging. 02 * Sec. 7. (a) The unexpended and unobligated balance of the appropriation, not to exceed 03 $40,000, made in sec. 163, ch. 96, SLA 1991, page 39, line 21 (Beaufort and Chukchi Seas 04 coastline mapping - $150,000) is repealed and reappropriated to the Department of Natural 05 Resources for repairs to Fire Lake Dam. 06 (b) The unexpended and unobligated balance, after the reappropriation made in (a) of 07 this section, of the appropriation made in sec. 163, ch. 96, SLA 1991, page 39, line 21 08 (Beaufort and Chukchi Seas coastline mapping - $150,000) is repealed and reappropriated to 09 the Department of Natural Resources for offshore boundary mapping and tide gauging. 10 * Sec. 8. Section 10, ch. 4, FSSLA 1994, page 12, lines 13 - 14, is amended to read: 11 APPROPRIATION GENERAL 12 ITEMS FUND 13 License plates/driver manuals, equipment (ED 99) 350,000 350,000 14 * Sec. 9. Section 10, ch. 4, FSSLA 1994, page 34, lines 10 - 11, is amended to read: 22 APPROPRIATION OTHER 23 ITEMS FUNDS 24 City of Kasaan - breakwater [BOAT HARBOR 33,300 33,300 25 EXPANSION/GRID/SERVICES] (ED 5) 26 * Sec. 11. Section 10, ch. 4, FSSLA 1994, page 38, lines 28 - 29, is amended to read: 27 APPROPRIATION OTHER 28 ITEMS FUNDS 29 City of Galena - Landfill and computer upgrade 33,400 33,400 30 [FRONT END LOADER] (ED 36) 31 * Sec. 12. Section 10, ch. 4, FSSLA 1994, page 45, lines 24 - 25, is amended to read:

01 APPROPRIATION OTHER 02 ITEMS FUNDS 03 Nelchina - Mendeltna solid waste transfer station, 25,000 25,000 04 phase II [COMMUNITY WELL] (ED 35) 05 * Sec. 13. The proceeds from the sale of two Grumman aircraft including parts inventory 06 by the Department of Public Safety are appropriated to the Department of Public Safety for 07 the purchase of one replacement aircraft. 08 * Sec. 14. (a) Amounts equal to the amounts deposited in the budget reserve fund (art. IX, 09 sec. 17, Constitution of the State of Alaska) for the fiscal year ending June 30, 1996, by 10 operation of art. IX, sec 17(d), to repay appropriations made from the budget reserve fund are 11 appropriated from the budget reserve fund to the funds and accounts from which they were 12 transferred. The appropriations made by this subsection are made under art. IX, sec. 17(c), 13 Constitution of the State of Alaska. 14 (b) If the unrestricted state revenue available for appropriation in fiscal year 1997 is 15 insufficient, after the appropriation to the general fund made in sec. 15 of this Act, to cover 16 the general fund appropriations made for fiscal year 1997, the amount necessary to balance 17 revenue and general fund appropriations is appropriated to the general fund from the budget 18 reserve fund (art. IX, sec. 17, Constitution of the State of Alaska). If the appropriation made 19 by this subsection is approved by the affirmative vote of at least three-fourths of the members 20 of each house of the legislature, the appropriation is made under art. IX, sec. 17(c), 21 Constitution of the State of Alaska. If the appropriation made by this subsection is not 22 approved by at least three-fourths vote of each house of the legislature, then the appropriation 23 is made under art. IX, sec. 17(b), Constitution of the State of Alaska, and the amount 24 appropriated under this subsection is limited to the amount permitted under art. IX, sec. 17(b). 25 * Sec. 15. If the unrestricted state revenue available for appropriation in the fiscal year that 26 ends June 30, 1997, is insufficient to cover the general fund appropriations made for that fiscal 27 year, the amount necessary to balance revenue and general fund appropriations is appropriated 28 to the general fund from the budget reserve fund (AS 37.05.540). 29 * Sec. 16. In its review of agency operations plans prepared under AS 37.07.080, it is the 30 intent of the legislature that the office of management and budget control state expenditures 31 to prevent any cash or budget shortfalls during fiscal year 1997. These controls are intended

01 to limit the use of the budget reserve fund (art. IX, sec. 17, Constitution of the State of 02 Alaska) to the greatest extent possible, and to reduce supplemental budget requests in the First 03 Session of the Twentieth Alaska State Legislature. 04 * Sec. 17. (a) Subject to the conditions set out in (c) of this section, the sum of $275,000 05 is appropriated from the appropriate individual grant accounts in the municipal capital project 06 matching grant fund (AS 37.06.010) for payment as grants under AS 37.06.010 to the 07 following municipalities in the amounts and for the purposes stated: 08 Anvik community facilities and equipment $25,000 09 Diomede community facilities and equipment 25,000 10 Eek community facilities and equipment 25,000 11 Holy Cross community facilities and equipment 25,000 12 Lower Kalskag community facilities and equipment 25,000 13 Nightmute community facilities and equipment 25,000 14 Nondalton community facilities and equipment 25,000 15 Pilot Station community facilities and equipment 25,000 16 Toksook Bay community facilities and equipment 25,000 17 Wainwright community facilities and equipment 25,000 18 Angoon community facilities and equipment 25,000 19 (b) Subject to the conditions set out in (c) of this section, the sum of $208,882 is 20 appropriated from the appropriate individual grant accounts in the unincorporated community 21 capital project matching grant fund (AS 37.06.020) for payment as grants under AS 37.06.020 22 to the following unincorporated communities in the amounts and for the purposes stated: 23 Circle community facilities and equipment $79,441 24 Gakona community facilities and equipment 79,441 25 Lake Minchumina community facilities and equipment 25,000 26 Northway community hall renovation 25,000 27 (c) The appropriations made by (a) and (b) of this section are made contingent on the 28 grantee complying before July 1, 1997, with the requirements, other than deadlines, set out 29 in AS 37.06. 30 * Sec. 18. SETTLEMENTS AND CLAIMS. The sum of $2,600,000 is appropriated from 31 the general fund to the Department of Law to pay the settlement in Kerr v. State, DOC, et al.

01 (3AN-93-6531 CI) for the fiscal year ending June 30, 1996. 02 (SECTION 19 OF THIS ACT BEGINS ON PAGE 7) * Sec. 21. LAPSE PROVISIONS. (a) The appropriations made by sec. 1 of th 03 to capitalize funds and do not lapse under AS 37.25.010. 04 (b) The appropriations made by secs. 2, 6, 7, 13, 17, and 19 of this Act are for capital 05 projects and lapse under AS 37.25.020. 06 * Sec. 22. Section 18 of this Act takes effect immediately under AS 01.10.070(c). 07 * Sec. 23. Except as provided in sec. 22 of this Act, this Act takes effect July 1, 1996.
