00CS FOR HOUSE JOINT RESOLUTION NO. 49(STA) 01 Proposing amendments to the Constitution of the State of Alaska creating a 02 highway fund from state taxes on fuel used for the propulsion of highway or 03 road use motor vehicles. 04 BE IT RESOLVED BY THE LEGISLATURE OF THE STATE OF ALASKA: 05 * Section 1. Article IX, sec. 7, Constitution of the State of Alaska, is amended to read: 06  SECTION 7. DEDICATED FUNDS. The proceeds of any State [STATE] tax 07 or license shall not be dedicated to any special purpose, except as provided in Section 08 15 and Section 18 of this article or when required by the federal government for State 09 [STATE] participation in federal programs. This provision shall not prohibit the 10 continuance of any dedication for special purposes existing on April 24, 1956 [UPON 11 THE DATE OF RATIFICATION OF THIS SECTION BY THE PEOPLE OF 12 ALASKA]. 13 * Sec. 2. Article IX, Constitution of the State of Alaska, is amended by adding a new section 14 to read:

01  SECTION 18. HIGHWAY FUND. (a) The revenue received after June 30, 02 1997, from State taxes on fuel used for the propulsion of motor vehicles designed for and 03 ordinarily used on highways or roads, less refunds, credits, and the costs of collection 04 of that tax as provided by law, shall be placed in a highway fund. Except as provided 05 in (d) of this section, the legislature may appropriate money from the fund only for the 06 maintenance of roads and highways by the State or a local government. 07  (b) This section does not apply to revenue received from taxes that the State 08 collects on behalf of a local government. 09  (c) The legislature shall provide by law for the management and investment of 10 the fund balance. The income earned from the management and investment of the fund 11 shall be deposited into the fund. 12  (d) An appropriation from the fund for a public purpose other than one described 13 in (a) of this section may be made upon an affirmative vote of three-fifths of the 14 members of each house of the legislature. 15 * Sec. 3. The amendments proposed by this resolution shall be placed before the voters of 16 the state at the next general election in conformity with art. XIII, sec. 1, Constitution of the State 17 of Alaska, and the election laws of the state.
