00HOUSE BILL NO. 503 01 "An Act relating to contributions from permanent fund dividends." 02 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF ALASKA: 03 * Section 1. AS 43.23 is amended by adding a new section to read: 04  Sec. 43.23.017. CONTRIBUTIONS FROM DIVIDENDS. (a) 05 Notwithstanding AS 43.23.069, the department shall prepare the permanent fund 06 dividend application to allow an applicant to direct that money be subtracted from the 07 dividend check and contributed to one or more nonprofit corporations that appear on 08 the contribution list contained in the application. A contribution to a nonprofit 09 corporation may be $25, $50, $100, $500, or the total amount the applicant is entitled 10 to, as indicated on the application. If the applicant directs that a contribution be made 11 but fails to specify the amount contributed, the contribution direction is invalid and 12 shall be treated by the department as though it had not been made. If the total amount 13 of contributions elected by an applicant exceeds the permanent fund dividend amount 14 that the applicant is entitled to receive, contributions shall be deducted from the

01 dividend in the order the corporations elected by the applicant appear on the 02 contribution list until the entire dividend amount that the applicant is entitled to receive 03 is allocated for contributions. 04  (b) A nonprofit corporation organized under the law of this state may petition 05 the department to have its name appear on the contribution list contained in the 06 permanent fund dividend application. The petition must be signed by at least 10,000 07 adult individuals who received permanent fund dividends for the year immediately 08 before the year the petition is submitted to the department. If the department receives 09 a valid petition by July 1 of a year and if the nonprofit corporation is operating and 10 has not dissolved, the nonprofit corporation shall appear on the contribution list for the 11 immediately following dividend year. 12  (c) A nonprofit corporation that appears on the contribution list for a dividend 13 year under (b) of this section may apply to appear on the list each year thereafter. The 14 application form shall be prepared by the department, and the department may request 15 proof that the corporation is operating and has not dissolved. If the department 16 receives an application by July 1 of a year and if the nonprofit corporation is operating 17 and has not dissolved, the nonprofit corporation shall appear on the contribution list 18 for the immediately following dividend year. 19  (d) Nonprofit corporations on the contribution list shall appear in random 20 order, and the order shall be changed every year. Notwithstanding (b) or (c) of this 21 section, a nonprofit corporation that has been convicted of a state or federal crime may 22 not appear on the contribution list.
