00HOUSE BILL NO. 422 01 "An Act prohibiting the adoption of regulations by an agency of the executive 02 branch of state government, annulling all regulations adopted by an agency of the 03 executive branch, repealing provisions of the Administrative Procedure Act, and 04 relating to additional legislation to carry out the purposes of this Act; and 05 providing for an effective date." 06 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF ALASKA: 07 * Section 1. AS 44.99 is amended by adding a new section to read: 08 Sec. 44.99.030. ADOPTION OF REGULATIONS PROHIBITED. 09 Notwithstanding any other provision of law, a department, board, commission, public 10 corporation, or other agency of the executive branch of state government may not 11 adopt a rule or regulation. 12 * Sec. 2. All rules and regulations adopted by a department, board, commission, public 13 corporation or other agency of the executive branch of state government are annulled. 14 * Sec. 3. (a) The revisor of statutes shall prepare a bill conforming the Alaska Statutes
01 to the changes made by this Act. The bill shall be presented to the House and Senate Rules 02 Committees for introduction on the first day of the First Regular Session of the Twentieth 03 Alaska State Legislature. 04 (b) Each agency of the executive branch of state government with the authority to 05 adopt regulations shall submit proposed draft legislation necessary to accommodate this Act 06 to the House and Senate Rules Committees on the first day of the First Regular Session of the 07 Twentieth Alaska State Legislature. 08 * Sec. 4. Section 3 of this Act takes effect immediately under AS 01.10.070(c). 18 * Sec. 6. Sections 1, 2, and 4 of this Act take effect July 1, 1997.
