00HOUSE BILL NO. 332 01 "An Act prohibiting charitable gaming permittees from contracting with operators 02 to conduct pull-tab games; and providing for an effective date." 03 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF ALASKA: 04 * Section 1. AS 05.15.115(c) is amended to read: 05  (c) A permittee may not contract with more than one operator at a time to 06 conduct the same type of activity. For the purposes of this subsection, bingo games, 07 raffles, lotteries, [PULL-TAB GAMES,] ice classics, rain classics, goose classics, 08 mercury classics, canned salmon classics, salmon classics, king salmon classics, dog 09 mushers' contests, fish derbies, contests of skill, and all activities permitted under 10 AS 05.15.100(b) are each a different type of activity. A permittee may not contract 11 with an operator to conduct pull-tab games. 12 * Sec. 2. AS 05.15.128(a) is amended to read: 13  (a) The department shall revoke the license of an operator who does not 14  (1) report an adjusted gross income of at least 15 percent of gross

01 income annually based on the total operation of the operator; or 02  (2) pay to each authorizing permittee annually at least [30 PERCENT 03 OF THE ADJUSTED GROSS INCOME, AS DETERMINED UNDER (1) OF THIS 04 SUBSECTION, FROM A PULL-TAB ACTIVITY OR AT LEAST] 10 percent of the 05 adjusted gross income, as determined under (1) of this subsection [, FROM A 06 GAMING ACTIVITY OTHER THAN PULL-TABS,] received from activities 07 conducted on behalf of the authorizing permittee. 08 * Sec. 3. AS 05.15.187(a) is amended to read: 09  (a) A municipality or qualified organization may conduct [OPERATE] pull-tab 10 games. A permittee may not contract with an operator to conduct a pull-tab 11 game. Pull-tabs shall be obtained from a licensed distributor. 12 * Sec. 4. AS 05.15.187(g) is amended to read: 13  (g) Notwithstanding other provisions of this chapter, a pull-tab game that 14 confers an additional right upon all or some of the purchasers of a pull-tab series to 15 participate in a lottery for additional prizes may not be conducted in the state unless 16 a surety bond in the amount of $250,000 conditioned upon payment of all prizes and 17 awards when due is submitted to the department by the [OPERATOR OR 18 AUTHORIZING] permittee and approved by the attorney general. 19 * Sec. 5. AS 05.15.187(h) is amended to read: 20  (h) An owner, manager, or employee of a person holding a permit [OR 21 LICENSE] under this chapter, or registered under this chapter as a vendor, may not 22 purchase a pull-tab from a pull-tab series manufactured, distributed, or sold by the 23 permittee [, LICENSEE,] or registered vendor. 24 * Sec. 6. AS 05.15.187(i) is amended to read: 25  (i) A permittee [, OPERATOR,] or registered vendor may not turn over a prize 26 of $50 or more to a person with a pull-tab card entitling the person to that prize unless 27 the person signs a receipt for the prize and returns the receipt to the permittee [, 28 OPERATOR,] or vendor. The receipt must be in a form approved by the department. 29 * Sec. 7. AS 05.15.185(2) and 05.15.188(j) are repealed. 30 * Sec. 8. This Act takes effect January 1, 1996.
