01 "An Act relating to the maintenance by health care providers of medical records                                         
02 in an electronic format."                                                                                               
03 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF ALASKA:                                                                
04    * Section 1.  AS 18.20.085 is amended by adding a new subsection to read:                                            
05  (e)  This section is subject to AS 18.95.010.                                                                         
06    * Sec. 2.  AS 18 is amended by adding a new chapter to read:                                                         
07 CHAPTER 95.  MISCELLANEOUS PROVISIONS.                                                                                  
08  Sec. 18.95.010.  USE OF ELECTRONIC MEDICAL RECORDS.  A health                                                         
09 care provider may maintain and preserve its medical records in an electronic format                                     
10 without maintaining a separate copy in a handwritten or other tangible format.  The                                     
11 Department of Health and Social Services may adopt regulations under AS 44.62                                           
12 (Administrative Procedure Act) to regulate the implementation of this section.
