00SENATE CS FOR HOUSE BILL NO. 180(CRA) 01 "An Act relating to liquor licenses issued to a hotel, motel, resort, or similar 02 establishment; and providing for an effective date." 03 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF ALASKA: 04 * Section 1. AS 04.11.400(d) is amended to read: 05  (d) The board may approve the issuance or transfer of ownership of a beverage 06 dispensary or restaurant or eating place license without regard to (a) of this section if 07 it appears that the issuance or transfer will encourage the tourist trade by encouraging 08 the construction or improvement of 09  (1) a hotel, motel, resort, or similar business relating to the tourist trade 10 with a dining facility or having kitchen facilities in a majority of its rental rooms and 11 at least a minimum number of rental rooms available to the public required according 12 to the population of the established village, incorporated city, unified municipality, or 13 population area established under (a) of this section in which the facility will be 14 located, as follows:

01  (A) 10 rental rooms if the population is less than 1,501; 02  (B) 20 rental rooms if the population is between 1,501 and 03 2,500; 04  (C) 25 rental rooms if the population is between 2,501 and 05 5,000; 06  (D) 30 rental rooms if the population is between 5,001 and 07 15,000; 08  (E) 35 rental rooms if the population is between 15,001 and 09 25,000; 10  (F) 40 rental rooms if the population is between 25,001 and 11 50,000; and 12  (G) 50 rental rooms if the population is greater than 50,000; 13 [OR] 14  (2) an airport terminal; 15  (3) a hotel, motel, resort, or similar business that is inside a unified 16 municipality or organized borough and has at least 10 rooms available to the 17 public for rent and that (A) cannot be reached by highway from the nearest first 18 or second class city or established village or (B) could be reached by highway 19 during no more than 10 of the 12 months in the calendar year preceding the year 20 in which the issuance or transfer is requested; in this paragraph, "highway" 21 means a road maintained by the state for use by public transportation. 22 * Sec. 2. This Act takes effect immediately under AS 01.10.070(c).
