00HOUSE BILL NO. 155 01 "An Act relating to hunting, trapping, and sport fishing licenses and to the 02 management of anadromous fisheries; and providing for an effective date." 03 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF ALASKA: 04 * Section 1. INTENT. It is the intent of the legislature that the additional revenue 05 generated by secs. 2 - 7 of this Act shall be deposited into the fish and game fund for sport 06 fish habitat protection, restoration, and enhancement and enforcement of habitat protection 07 measures to the extent permitted under the Federal Aid in Fish Restoration Act (16 U.S.C. 08 777-7771). 09 * Sec. 2. AS 16.05.340(a)(1) is amended to read: 10  (1) Resident sport fishing license . . . . . . . . . . . . . . . . $20 [$15] 11 However, the fee is 25 cents for a resident who is blind. 12 * Sec. 3. AS 16.05.340(a)(5) is amended to read: 13  (5) Resident hunting and sport fishing license . . . . . . . . . . . 45 [40] 14 * Sec. 4. AS 16.05.340(a)(6) is amended to read:

01  (6) Resident hunting, trapping, and sport fishing license . . . . . . 60 [55]; 02  (A) however, the fee is $5 for an applicant who 03  (i) is receiving or has received assistance during the 04 preceding six months under any state or federal welfare program to aid 05 the indigent, or 06  (ii) has an annual family gross income of less than 07 $8,200 for the year preceding application; 08  (B) a person paying $5 for a resident hunting, trapping, and 09 sport fishing license must provide proof of eligibility under this paragraph 10 when requested by the departments. 11 * Sec. 5. AS 16.05.340(a)(8) is amended to read: 18  (8) Nonresident sport fishing license . . . . . . . . . . . . . . . . .55 [50] 19 * Sec. 7. AS 16.05.340(a)(10) is amended to read: 20  (10) Nonresident hunting and sport fishing license. . . . . . . 140 [135] 21 A nonresident may not take a big game animal without previously purchasing a 22 numbered, nontransferable, appropriate tag, issued under (15) of this subsection. The 23 tag must be affixed to the animal immediately upon capture and must remain affixed 24 until the animal is prepared for storage, consumed, or exported. A tag issued but not 25 used for an animal may be used to satisfy the tagging requirement for an animal of any 26 other species for which the tag fee is of equal or less value. 27 * Sec. 8. AS 16.05 is amended by adding a new section to article 5 to read: 28  Sec. 16.05.735. MANAGEMENT OF ANADROMOUS FISH. (a) 29 Notwithstanding AS 16.05.251(e), in a fishing area where the average estimated 30 noncommercial fishing effort for all fishery resources exceeds 500,000 angler-days per 31 year for the preceding three years, the Board of Fisheries shall give priority to the

01 management of anadromous fishery resources for noncommercial fisheries over 02 commercial fisheries. The board shall manage anadromous fishery resources under this 03 section in order to reasonably satisfy the demand for noncommercial use of 04 anadromous fish. 05  (b) This section is subject to AS 16.05.258. 06  (c) In this section, 07  (1) "fishing area" means the saltwater and freshwater areas of a 08 commercial fisheries management area that consists of fishing districts, subdistricts, 09 and sections and that is established by the Board of Fisheries for the management of 10 commercial fisheries; 11  (2) "noncommercial fisheries" means personal use, sport, and guided 12 sport fisheries. 13 * Sec. 9. This Act takes effect January 1, 1996.
