00SENATE CS FOR CS FOR HOUSE BILL NO. 141(RES) 01 "An Act relating to the appointment of members of the Board of Fisheries." 02 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF ALASKA: 03 * Section 1. AS 16.05.221(c) is amended to read: 04  (c) Members of the [BOARD OF FISHERIES OR] Board of Game serve 05 staggered terms of three years and until a successor is appointed. An appointment to 06 fill a vacancy in the membership of the [BOARD OF FISHERIES OR] Board of Game 07 shall be made in the same manner as the original appointment and for the balance of 08 the unexpired term. 09 * Sec. 2. AS 16.05.221 is amended by adding a new subsection to read: 10  (d) Members of the Board of Fisheries serve staggered terms of three years. 11 The terms of members of the board begin on July 1. Notwithstanding 12 AS 39.05.080(1), by April 1 of the calendar year in which the term expires, the 13 governor shall appoint a person to fill the vacancy that will arise on the board due to 14 expiration of the term of a member of the board and submit the name of the person

01 to the legislature for confirmation. If a vacancy arises on the board, the governor 02 shall, within 30 days after the vacancy arises, appoint a person to serve the balance of 03 the unexpired term and submit the name of the person to the legislature for 04 confirmation. A person appointed to fill the balance of an unexpired term shall serve 05 on the board from the date of appointment until the earlier of the expiration of the 06 term or the failure of the legislature to confirm the person under AS 39.05.080. 07 * Sec. 3. TRANSITION. Notwithstanding AS 16.05.221(d), added by sec. 2 of this Act, 08 the 09 (1) expiration date of the terms of the persons serving on the Board of 10 Fisheries on January 1, 1995, is January 31 of the calendar year in which the term expires; 11 (2) terms of persons appointed to the Board of Fisheries after January 1, 1995, 12 other than the terms of persons appointed to serve the balance of an unexpired term, begin 13 upon the expiration of the predecessor's term and expire three calendar years later on June 30.
