00SPONSOR SUBSTITUTE FOR HOUSE BILL NO. 128                                                                               
01 "An Act establishing an exemption to the requirement of obtaining a waste                                               
02 disposal permit for certain activities that yield water and waste material discharges                                   
03 ancillary to those activities."                                                                                         
04 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF ALASKA:                                                                
05    * Section 1.  AS 46.03.100 is amended by adding a new subsection to read:                                            
06  (f)  Except as to discharges arising out of exploration and development drilling                                      
07 for oil and gas resources, this section does not apply to                                                               
08   (1)  waste material discharges or water discharges that will arise from                                              
09   (A)  the following activities if the discharge is incidental to the                                                 
10 activity, the activity is carried out in a manner consistent with established                                           
11 industry procedures, and the activity does not produce a discharge from a point                                         
12 source, as that term is defined in regulations adopted under this chapter,                                              
13 directly into any surface water of the state:                                                                           
14   (i)  mineral drilling, trenching, and similar activities;                                                          

01   (ii)  facility construction and maintenance;                                                                       
02   (iii)  road or other transportation facility construction and                                                      
03 maintenance;                                                                                                            
04   (iv)  landscaping;                                                                                                 
05   (v)  well drilling, geophysical drilling, or coal bed                                                              
06 methane drilling; or                                                                                                    
07   (B)  bilge pumping, unless the bilge product pumped includes                                                        
08 oily sludge, oily refuse, or any mixture of oil with the pumped wastes; or                                              
09   (2)  heating process or cooling water discharges that will arise from a                                              
10 boat or vessel into any surface water of the state.
