01 "An Act relating to the operation of bicycles on state highways; prohibiting motor                                      
02 vehicle operators or occupants from harassing bicycle operators; and encouraging                                        
03 the safe use of bicycles as a basic means of transportation."                                                           
04 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF ALASKA:                                                                
05    * Section 1.  AS  28.05.011 is amended by adding a new subsection to read:                                           
06  (b)  The commissioner may not adopt a regulation that prohibits the operation                                         
07 of a bicycle on a highway.  The commissioner may regulate the manner of operation                                       
08 of a bicycle.                                                                                                           
09    * Sec. 2.  AS 28.35 is amended by adding a new section to read:                                                      
10  Sec. 28.35.237.  HARASSMENT OF BICYCLIST.  A person commits the                                                       
11 crime of harassment of a bicyclist if the person, while operating a motor vehicle or as                                 
12 a passenger of a motor vehicle, directs loud, angry, or obscene verbal abuse at an                                      
13 operator of a bicycle for the purpose of threatening or intimidating the operator of the                                
14 bicycle or limiting or preventing the bicyclist's lawful use of the highway.                                            

01    * Sec. 3.  AS 44.42.020(a) is amended by adding new paragraphs to read:                                              
02   (16)  when planning, designing, and constructing highways, provide for                                               
03 the safe use of those highways by bicycles as a basic means of transportation;                                          
04   (17)  develop facilities and programs that encourage the safe use of                                                 
05 bicycles as a basic means of transportation.
