00HOUSE BILL NO. 40                                                                                                       
01 "An Act relating to motor vehicle speeding offenses; and providing for an                                               
02 effective date."                                                                                                        
03 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF ALASKA:                                                                
04    * Section 1.  AS 28.40 is amended by adding a new section to read:                                                   
05  Sec. 28.40.060.  RADAR ERROR MARGIN.  If radar is used as evidence of                                                 
06 the commission of a speeding offense described by law and the radar has an inherent                                     
07 margin of error that is equal to or less than one percent, the standards of the law are                                 
08 not affected by the inherent margin of error.                                                                           
09    * Sec. 2.  This Act takes effect September 1, 1995.
