00HOUSE BILL NO. 5 01 "An Act relating to absences from the state for purposes of determining eligibility 02 for permanent fund dividends and longevity bonus payments; and providing for 03 an effective date." 04 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF ALASKA: 05 * Section 1. AS 43.23.095(8) is amended to read: 06  (8) "state resident" means an individual who is physically present in the 07 state with the intent to remain permanently in the state under the requirements of 08 AS 01.10.055 or, if the individual is not physically present in the state, intends to 09 return to the state and remain permanently in the state under the requirements of 10 AS 01.10.055, and is absent only for any of the following reasons: 11  (A) vocational, professional, or other specific education for 12 which a comparable program was not reasonably available in the state; 13  (B) secondary or postsecondary education; 14  (C) military service;

01  (D) medical treatment; 02  (E) service in Congress; 03  (F) other reasons that [WHICH] the commissioner may 04 establish by regulation; [OR] 05  (G) service in the Peace Corps; 06  (H) service as a volunteer of the American Red Cross; or 07  (I) service as a volunteer of the International Executive 08 Services Corps; 09 * Sec. 2. AS 47.45.030 is amended by adding a new subsection to read: 10  (b) Notwithstanding (a) of this section and AS 47.45.070(4), a recipient who 11 has been absent from the state but is otherwise qualified for bonuses is not disqualified 12 from receiving them after returning to the state if the absence was due to service as 13 a volunteer of the American Red Cross or the International Executive Services Corps. 14 * Sec. 3. This Act takes effect January 1, 1996.
