SJR 47: Proposing amendments to the constitution of the State of Alaska changing the membership of the Judicial Council.

00SENATE JOINT RESOLUTION NO. 47 01 Proposing amendments to the constitution of the State of Alaska changing the 02 membership of the Judicial Council. 03 BE IT RESOLVED BY THE LEGISLATURE OF THE STATE OF ALASKA: 04 * Section 1. Article IV, sec. 8, Constitution of the State of Alaska, is amended to read: 05  SECTION 8. JUDICIAL COUNCIL. The judicial council shall consist of 06 seven members. One [THREE] attorney member [MEMBERS] shall be appointed 07 for a six-year term [TERMS] by the governing body of the organized state bar. Five 08 [THREE] non-attorney members shall be appointed for six-year terms by the governor 09 subject to confirmation by a majority of the members of the legislature in joint session. 10 Vacancies shall be filled for the unexpired term in like manner. Appointments shall 11 be made with due consideration to area representation and without regard to political 12 affiliation. The chief justice of the supreme court shall be ex-officio the seventh 13 member and chair [CHAIRMAN] of the judicial council. No member of the judicial 14 council, except the chief justice, may hold any other office or position of profit under

01 the United States or the State. The judicial council shall act by concurrence of four 02 or more members and according to rules which it adopts. 03 * Sec. 2. Article XV, Constitution of the State of Alaska, is amended by adding a new 04 section to read: 05  SECTION 29. MEMBERSHIP OF JUDICIAL COUNCIL. If the 1994 06 amendment changing the composition of the Judicial Council is adopted, 07 notwithstanding Section 8 of Article IV, as amended, the two attorney members 08 serving on the effective date of the amendment whose terms first expire may continue 09 to serve on the council for the remainder of their terms. Upon the expiration of a 10 term, the vacancy shall be filled under Section 8, Article IV, as amended. 11 * Sec. 3. The amendment proposed by this resolution shall be placed before the voters of 12 the state at the next general election in conformity with art. XIII, sec. 1, Constitution of the 13 State of Alaska, and the election laws of the state.
