HCS SJR 39(JUD): Proposing amendments to the Constitution of the State of Alaska to guarantee, in addition to the right of the people to keep and bear arms as approved by the voters at the time of ratification of the state Constitution, that the individual right to keep and bear arms shall not be unreasonably denied or infringed by the state or a political subdivision of the state, and establishing that the expanded right to keep and bear arms does not change the level of judicial scrutiny applicable to the review of laws relating to weapons.

00HOUSE CS FOR SENATE JOINT RESOLUTION NO. 39(JUD) 01 Proposing amendments to the Constitution of the State of Alaska to guarantee, 02 in addition to the right of the people to keep and bear arms as approved by 03 the voters at the time of ratification of the state Constitution, that the individual 04 right to keep and bear arms shall not be unreasonably denied or infringed by 05 the state or a political subdivision of the state, and establishing that the 06 expanded right to keep and bear arms does not change the level of judicial 07 scrutiny applicable to the review of laws relating to weapons. 08 BE IT RESOLVED BY THE LEGISLATURE OF THE STATE OF ALASKA: 09 * Section 1. Article I, sec. 19, Constitution of the State of Alaska, is amended to read: 10  SECTION 19. RIGHT TO KEEP AND BEAR ARMS. A well-regulated 11 militia being necessary to the security of a free state, the right of the people to keep 12 and bear arms shall not be infringed. The individual right to keep and bear arms 13 shall not be unreasonably denied or infringed by the State or a political 14 subdivision of the State.

01 * Sec. 2. Article XV, Constitution of the State of Alaska, is amended by adding a new 02 section to read: 03  SECTION 29. APPLICATION OF AMENDMENT OF SECTION 19 OF 04 ARTICLE I. The 1994 amendment of Section 19 of Article I does not change the 05 level of judicial scrutiny applicable to the review of laws relating to weapons. 06 * Sec. 3. The amendments proposed by this resolution shall be placed before the voters of 07 the state at the next general election in conformity with art. XIII, sec. 1, Constitution of the 08 State of Alaska, and the election laws of the state.
