00CS FOR SPONSOR SUBSTITUTE FOR SENATE BILL NO. 301(FIN) am 01 "An Act allowing a school district to offset a reduction of five percent or more 02 in elementary and secondary school instructional units that the district is eligible 03 to receive under the foundation formula; increasing the elementary and secondary 04 instructional units received in a district that consists of a single funding 05 community with an average daily membership of 800 or fewer students; and 06 providing for an effective date." 07 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF ALASKA: 08 * Section 1. AS 14.17.031(b) is amended to read: 09  (b) If the total elementary and secondary instructional units that a school 10 district is eligible to receive under (a) of this section decrease by at least five but less 11 than 25 [10] percent [OR MORE] from one fiscal year to the next, the school district 12 may use the last fiscal year before the reduction as a base fiscal year and offset its 13 reduction according to the following schedule: (1) for the first fiscal year after the base 14 fiscal year, the school district is eligible to receive the total elementary and secondary

01 instructional units determined under (a)(1) of this section plus 75 percent of the 02 difference in total elementary and secondary instructional units between the base fiscal 03 year and the first fiscal year after the base fiscal year; (2) for the second fiscal year 04 after the base fiscal year, the school district is eligible to receive the total elementary 05 and secondary instructional units determined under (a)(1) of this section plus 50 06 percent of the difference in total elementary and secondary instructional units between 07 the base fiscal year and the second fiscal year after the base fiscal year; (3) for the 08 third fiscal year after the base fiscal year, the school district is eligible to receive the 09 total elementary and secondary instructional units determined under (a)(1) of this 10 section plus 25 percent of the difference in total elementary and secondary instructional 11 units between the base fiscal year and the third fiscal year after the base fiscal year. 12 The schedule established in this subsection is available to a school district for the three 13 fiscal years following the base fiscal year only if the total elementary and secondary 14 instructional units received by the school district under (a)(1) of this section for each 15 fiscal year are less than the total elementary and secondary instructional units received 16 by the school district in the base fiscal year. This subsection does not apply to a 17 decrease in total elementary and secondary instructional units resulting from a loss of 18 enrollment that occurs as a result of a boundary change under AS 29. 19 * Sec. 2. AS 14.17.031 is amended by adding new subsections to read: 20  (c) If the total elementary and secondary instructional units that a school 21 district is eligible to receive under (a) of this section decrease by at least 25 percent 22 but less than 50 percent from one fiscal year to the next, the school district may use 23 the last fiscal year before the reduction as a base fiscal year and offset its reduction 24 according to the following schedule: (1) for the first fiscal year after the base fiscal 25 year, the school district is eligible to receive the total elementary and secondary 26 instructional units determined under (a)(1) of this section plus 67 percent of the 27 difference in total elementary and secondary instructional units between the base fiscal 28 year and the first fiscal year after the base fiscal year; (2) for the second fiscal year 29 after the base fiscal year, the school district is eligible to receive the total elementary 30 and secondary instructional units determined under (a)(1) of this section plus 33 31 percent of the difference in total elementary and secondary instructional units between

01 the base fiscal year and the second fiscal year after the base fiscal year. The schedule 02 established in this subsection is available to a school district for the two fiscal years 03 following the base fiscal year only if the total elementary and secondary instructional 04 units received by the school district under (a)(1) of this section for each fiscal year are 05 less than the total elementary and secondary instructional units received by the school 06 district in the base fiscal year. This subsection does not apply to a decrease in total 07 elementary and secondary instructional units resulting from a loss of enrollment that 08 occurs as a result of a boundary change under AS 29. 09  (d) If the total elementary and secondary instructional units that a school 10 district is eligible to receive under (a) of this section decrease by 50 percent or more 11 from one fiscal year to the next, the school district may use the last fiscal year before 12 the reduction as a base fiscal year and offset its reduction. For the first fiscal year 13 after the base fiscal year, the school district is eligible to receive the total elementary 14 and secondary instructional units determined under (a)(1) of this section plus 50 15 percent of the difference in total elementary and secondary instructional units between 16 the base fiscal year and the first fiscal year after the base fiscal year. The schedule 17 established in this subsection is available to a school district for one fiscal year 18 following the base fiscal year. This subsection does not apply to a decrease in total 19 elementary and secondary instructional units resulting from a loss of enrollment that 20 occurs as a result of a boundary change under AS 29. 21 * Sec. 3. AS 14.17.041 is amended by adding a new subsection to read: 22  (e) In a district that consists of a single funding community with an average 23 daily membership of 800 or fewer students, the elementary and secondary 24 instructional units received under (a) or (b) of this section shall be multiplied by the 25 factor determined under the following table: 26 ADM Factor 27 1 - 250 1.12 28 251 - 525 1.08 29 526 - 800 1.06. 30 * Sec. 4. This Act takes effect July 1, 1994.
